The "big affair" collapses

Last year, the Special Prosecutor's Office indicted 10 officials of the Ministry of Infrastructure. He accused them of corruption and it was considered the biggest investigation in 2023. But this indictment has not even passed the confirmation filter. At the stage of opposition to the accusations, the Court considered that there was not enough evidence, therefore the investigation was closed without holding a trial at all.

On August 23 of last year, the Special Prosecutor's Office announced through a press release that it has filed an indictment for corruption against 10 officials and former officials of the Ministry of Infrastructure.

But this indictment has not even passed the confirmation filter.

The Basic Court in Pristina, without a trial, based only on the preliminary complaints of the accused, dismissed the indictment in its entirety.

"The requests to drop the indictment of the defenders of the defendants: Betim Reçica, Valmira Bllaca, Zymer Avdullahu, Jetmir Alaj, Emir Morina, Izedin Bytyqi, Muhamet Gashi, Blerim Dina and Nuhi Paçarizi," the Court's decision states.

Judge Mentor Bajraktari justified the dismissal of the indictment with the lack of evidence that the Special Prosecutor's Office submitted for this case.

"There is not enough evidence to support the well-founded suspicion that the defendants have committed the criminal offense for which they are accused in the indictment," the verdict states.

For each point, the Court found that the Special Prosecutor's Office did not collect enough facts and for some points, nor did it read and consult the legal basis.

KOHA tried to contact the prosecutor of the case, but was unsuccessful.

The State Prosecutor's Office launched investigations into the tender "Reconstruction of the Regional Road Segment Prizren-Prevalle", as early as 2020.

For three years, the special prosecutor in coordination with the investigators of the Unit for Special Investigations Against Corruption collected evidence, on which the indictment was based.

But since then, all that has happened in this judicial process is the stage of opposition of the charges by the accused, which is equivalent to the stage of confirmation of the charge before the start of the judicial process.

Part of this indictment were secretaries and directors of departments in the Ministry of Infrastructure, including the former secretary Betim Reçica and the current secretary, Izedin Bytyqi.
