In the absence of the law and with old administrative instructions, IVF is expected to start in the KKUK in December

The Minister of Health, Arben Vitia, has said that the process will be carried out at the Gynecology Clinic, based on the administrative instruction of 2013, since the law has not been approved by the Assembly for more than a year. He also enumerated the problems with the private sector, which stem from the inability to impose the sanctions provided for in the draft law.

The Minister of Health, Arben Vitia, has warned that from next month, the service of medically assisted fertilization will begin to be offered in the public sector.

He said on Wednesday that they have already started preparations for this.

"When will it start? During this year. That is, at the beginning of December, the first two weeks of December. The devices have also arrived. Certain drugs, hormone stimulants, are also needed there, which, in cooperation with the key committee for the list of essential drugs, have already been included in the essential list. The procedures for securing them have started", said Vitia during the press conference, after the Government meeting.

Medically assisted fertilization, known as IVF, will only be performed for couples who have their own cells for fertilization, but pregnancy cannot be achieved in the normal way.

He also enumerated the problems with the private sector that are the source of the inability to impose the sanctions provided for in the draft law.

"I have a problem in the private sector - it can continue the same as it has continued earlier and we, not having a legal basis, unfortunately cannot make sanctions, which are necessary and this law naturally regulated all this, because the instruction the current one also allows what others are saying that it does not allow, it allows, but on the other hand, it does not even allow us to monitor and sanction", said Vitia.

In the absence of the law, private hospitals and even the new ward at the Gynecology Clinic are exempted from punishment for any violation, since the sanctions provided for by the Administrative Instruction are inapplicable.

After the 2016 changes in the Misdemeanor Law, it is determined that a fine cannot be imposed on any institution if the law does not provide for it.

E, the Draft Law on IVF, which has not been approved because some deputies of the Vetëvendosje Movement (LVV) have opposed it, foresees that even unmarried women have the right to use the medically assisted fertilization service, over 18 years old, who are in good health and social condition and who are capable of "fertilization and parental care".
In October last year, after many efforts, the Assembly managed to approve this draft law in the first reading with 63 votes for, one against and four abstentions.

The draft law has stalled in the amendments of the former deputy of the LVV, Visar Korenica, now independent, who has proposed changes, requesting that three paragraphs be removed from the legislation, which provide that the right to reproduction also belongs to women unmarried and same-sex partners.
