The measure of house arrest of 30 days has been assigned to the defendant AG as it is suspected that in the capacity of a gynecologist he performed an abortion on a minor. The Basic Court in Gjilan announced on Thursday that it had also dictated to the injured party what to write in her statement about giving consent for the abortion.

According to an announcement from this court, the defendant is alleged not to have reported the criminal offense of rape.

"With these actions, the defendant AG is suspected of having committed the criminal offenses of 'termination of pregnancy' and failure to report criminal offenses and their perpetrators", offenses sanctioned by the Criminal Code of the Republic of Kosovo (KPRK)", the announcement states.

The court announced that the prosecution had initially requested the imposition of a measure of detention, but "after hearing the statement of the defendant and his defense counsel, requested that the measure of house arrest be imposed, since the same has promised the Court that it will not affect the witnesses".

"The judge of the preliminary procedure in the Department of Serious Crimes, after holding the hearing, considered that the legal conditions for the imposition of house arrest against the defendant have been met, since the imposition of other alternative measures would hinder the normal development of the procedure criminal", it is further stated in the announcement, where it is announced that the parties have the right to appeal against this decision in the Court of Appeal.

At the end of the announcement, it is emphasized that on September 29, the Court had ordered a one-month detention measure against the two defendants who allegedly raped the minor.
