The removal of the Serbian List does not hinder the functioning of the institutions, but it violates the Constitution

The MPs and Minister of the Government of Kosovo from the ranks of the Serbian List who on Saturday decided to leave the institutions of Kosovo, have been boycotting them for more than four months. Since the end of June until now, the deputies of the Serbian List have not participated in the sessions of the Assembly of Kosovo, and Minister Goran Rakić in the meetings of the Government

"Serb List is in Belgrade...", this is what the Speaker of the Parliament of Kosovo declared in one case, when representatives of the parliamentary group of the Serbian List were absent from the hall of the Assembly of Kosovo.

Its MPs, who on Saturday declared their departure from Kosovo's institutions, have been boycotting them for about four months. Article 70 of the Constitution of Kosovo provides that the mandate of a deputy is terminated if he does not participate in the work for six consecutive months.

In the current case of the withdrawal of the deputies of the Serbian List, the Law on Elections provides for their replacement with the persons who were left out of the electoral list of this party.

And in the case of resigned ministers, the continuation of the exercise of this duty by the deputy is envisaged.

The decision of the leadership of the Serbian List to withdraw from the institutions, according to experts, does not affect their functioning.

"The dissolution of the Assembly is defined by the Constitution, which precisely defines the conditions under which situations the dissolution may occur. So, LS finds such an action impossible. The Assembly can be considered inactive if it does not have the necessary majority for its functioning", said Flamur Hyseni, university professor of law.

For university professor of Law, Flamur Hyseni, not even Rakić's resignation affects the functioning of the Government.

"Leaving the Government does not affect the functioning of the Government, because there are other constitutional solutions and as long as there is no successful no-confidence motion against the Government, then the Government is in constitutional mandate", added Hyseni.

And for the professor of International Relations, Dritëro Arifi, Rakiqi has violated the Constitution by resisting the decisions of the Kosovo institutions, of which he was a part.

The decision to withdraw from the institutions was taken by Lista Serbe after the meeting held in Zveçan.
