The local executive of Prizren has forwarded to the Municipal Assembly the proposal for the cancellation of the decision to allow the distribution of financial resources for newborn children, which was approved in the session held on May 21, 2021. This decision has been returned for reconsideration from the level central, on the grounds that it is illegal. In the proposal of the municipal government, the request of the MLGA for the reconsideration of this decision is mentioned, as well as the impossibility of the local level to meet the legal requirements mentioned by the central level.
The decision of the KK of Prizren to allow the allocation of financial resources for newborn children was approved on May 21, 2021 and a week later it was submitted for review to the MLGA. The latter was processed by the Ministry of Finance on May 31, 2021, as well as the amendment of the decision sent again for review by the Municipality of Prizren on June 11, 2021.
The Ministry of Finance, after examining this act, has assessed that it is not in accordance with the provisions of the legislation in force.
In its letter, the Ministry of Finance announced that in the first version of the decision of the Municipal Council of Prizren, the category from which the measure defined in the municipal act is intended to be implemented was not specified. Following the request of the Ministry of Finance, the Municipality has clarified that the allocation of financial resources will be carried out from the category of goods and services as well as the category of subsidies and transfers.
Examining the possibility of the Municipality to implement the decision through these categories, the MoF has consulted the relevant legislation.

"The Ministry, in consultation with the legal provisions defined in the Budget Law, as well as with the responsible structures of the Ministry for the budget of the Municipality of Prizren, has evidenced that the budgetary organization in question has not planned, nor publicly approved the potential expenses with the municipal administrative act. This, therefore, contradicts the spirit of the LMFPP, as well as the limits set for the budget organization by the Budget Law", says the letter of the Ministry of Finance, in which it is requested that the Municipality in the process of further with the municipal act to act in accordance with the provisions of the LMFPP.
The Ministry of Finance has emphasized that the Municipality can adjust the budget allocation up to 5 percent on its own, while above this percentage it needs the approval of the Ministry of Finance, the Government, or the Assembly of Kosovo, depending on the percentage of the adjustment that is intended.
"If the Municipality of Prizren, even after taking into consideration the above findings, finds that there are no means available for the realization of this decision in 2021 and the adjustment of the budget allocation is impossible on the same premises, it is estimated that we are dealing with budget overrun, and in this context, the Ministry reminds the Municipality to act in accordance with the municipal budget opportunities, as well as in accordance with the responsibilities of budget organizations in spending public money, as defined by the legal provisions in the LMFPP".
Based on this, the MF has proposed that the MLGA request the Municipality of Prizren to harmonize this act with the legal provisions in force within a period of 30 days.
The members of the Prizren KK in the continuation of the third session had approved the above-mentioned decision. Councillor, Sadije Osaj-Jakupi, presenting the request of the Women's Group, proposed that parents with permanent residence in the Municipality of Prizren from January 2021 be supported with 250 euros for the first child, 300 euros for the second child and 350 euros for the third child and beyond. She emphasized that the request for the approval of financial aid for each newborn child was made two years ago by the Women's Group of the Assembly of Prizren, as well as by some other councilors.
During the discussions, the remark was addressed that an explanation should be provided by the Executive regarding this matter, but the proposal was put to a vote by the chairperson of the Central Committee.

"Voting is being done, but it cannot be done", was the comment of the director of the Administration, Osman Hajdari, while the chairman Sultan Badallaj concluded that this decision was approved with 26 votes in favor and 1 abstention.
The next meeting of the KK of Prizren is planned to be held on September 9, 2021.
