In the Specialized Chambers of Kosovo in The Hague, the Office of the Specialized Prosecutor is giving the closing statement in the court case against Hysni Gucat and Nasim Haradinaj. According to the prosecution, witness intimidation and obstruction of justice have influenced the investigations and trials of KLA members for 20 years. The ZPS stated that the accused are not above the law and according to them this office has presented sufficient evidence to prove their guilt.
In the closing statement, the prosecutor Valeria Bolici said that it was not contested that Hysni Gucati and Nasim Haradinaj made public the confidential documents of the ZPS which contained names of protected witnesses.
According to the prosecution, the evidence against Gucat and Haradinaj is very convincing.
"Behavior of intimidation of witnesses and obstruction of justice have affected the investigations and trials of KLA members for 20 years. This case is very unique because those responsible for intimidation and obstruction of proceedings have been brought to account before a court of justice, and also because the evidence against the accused is very convincing, it is extremely convincing. From the beginning of this trial, the SPS has shown in this court that the criminal behavior of the accused is recorded in a number of videos that have been broadcast publicly, in these audiovisual evidences, the accused are seen when they commit the criminal behavior alleged in the indictment". said the prosecutor Bolici.
According to her, in the public appearances of the accused, they have admitted that they are carrying out the actions intentionally to undo the Special Court.

According to her, additional evidence was presented by the witnesses of the ZPS and by those of the defense.
"The prosecution respectfully submits that if the facts of this case are not ignored and if the applicable law is not misinterpreted, the criminal responsibility of these accused will be accepted as very clear. The defense knows this very well and therefore argues that the accused should nevertheless be acquitted of criminal responsibility based on a number of contrived defenses which are not based on sound provisions. During the entire trial, the accused tried to present themselves as the representatives, the flag bearers of a high justice, they say that they should not be punished because by breaking the law they followed the goals of justice that have defined themselves", Bolici said.
Before the jury, the prosecutor said that the actions of the accused violated the Criminal Code of Kosovo.
"We will say without hesitation that the accused are not above the law, their repeated and deliberate actions have violated the Criminal Code of Kosovo and are not justified by other criminal provisions, the accused are criminals. In today's closing statement, the SPS will say that the prosecution has presented evidence that proves their guilt or responsibility beyond reasonable doubt," she said.
The hearing in The Hague continues with the prosecution's closing statement, while Gucati and Haradinaj are present in the courtroom.
