Meanwhile, people who block roads and impede the movement of vehicles during rallies will be fined 5 lek for each day of blockage. Fines will be imposed by the State Police, in accordance with the legislation on administrative offenses.
The new package gives the head of the local police department, with the approval of the prefect, the ability to prohibit or restrict gatherings in a defined perimeter around educational, health or state institutions, when there is a real, serious and imminent risk of violence or serious damage to property. The restriction can last up to 72 hours and can be renewed only once, with a new reasoned decision.
The amendments also define protected areas, which include public transport stations and terminals, ports, airports, the perimeters of educational and healthcare institutions and cultural heritage sites. In certain cases, the police can order a person to leave these areas for a period of up to 48 hours.
Likewise, the police will record, through audiovisual means, warnings to disperse gatherings, as well as acts of violence against persons or damage to property, subject to the rules for the storage and processing of personal data.
In addition to the changes to the law on gatherings, the government has also approved the creation of a special electronic registry for persons referred to the prosecution or under investigation for criminal offenses against state authority, public order and security, when the facts are related to violent actions during public gatherings and protests.
The register will be administered by the General Directorate of the State Police and will contain data on persons identified in the materials referred to the prosecution, for whom concrete violent actions against persons or public and private property are documented.
The decision provides that the Border Police will have limited access to the register for border checks and the implementation of legal measures. In cases where the individual check reveals concrete evidence of participation in violent acts, the border authorities may administratively refuse to allow the person to leave the country, under the conditions set out in the legislation on state border control.
If the person is not refused exit, the border authorities are expected to notify the authorities of the country where he is traveling of the fact that he has been referred for the relevant offenses.
The police are also expected to notify private accommodation structures of persons for whom there is concrete evidence of participation in violent acts and for whom the materials have been referred to the prosecutor's office.
According to the decision, the need to retain the data of the referred persons must be reviewed within 30 days of registration. If the prosecution announces the non-initiation of criminal proceedings or the dismissal of the case, the person's data is deleted from the register.
The decision stipulates that data processing and exchange must be carried out in accordance with personal data protection legislation, guaranteeing confidentiality, access limitation and proportionality.
