The Central Election Commission has decided not to comment too long on the lawsuit that the People's Advocate filed against this institution a day earlier.
The Central Election Commission has certified 1 candidates for deputies, of which 067 are women and 343 are men, but the People's Advocate does not agree with this. This institution has sued the CEC regarding the violation of the right to equal treatment of women in electoral and participation rights.
The lawyer says that the CEC, according to its mandate, has certified the lists with the names of the candidates for deputies proposed by the political entities for the early elections for the Assembly of the Republic of Kosovo, but did not take into account the constitutional and legal guarantees as it concerns gender equality, specifically the equal treatment of women in electoral and participation rights.
The spokesman of the CEC, Valmir Elezi, has said that they do not comment on the lawsuit in question as it has already been submitted to the Basic Court in Pristina. He told KosovaPress that this institution supervised the implementation of Article 27 of the law on general elections regarding the gender quota.
"What we can say is that the CEC has supervised and guaranteed the implementation of Article 27 of the law on general elections, where the gender quota issue is defined. Article 27 states that in the list of candidates of each political subject at least 30% are men and at least 30% are women. I can confirm that the lists brought by the political subjects have been examined even if they are in accordance with this article of this law", said Elezi.
Likewise, the People's Advocate requested that the CEC stop undertaking activities that violate or may violate the right to equal treatment, or carry out activities that eliminate discrimination or its consequences in relation to the unequal treatment of women in electoral and participation rights.
The People's Advocate has attached to the lawsuit in question the request for a temporary measure in the election process, based on the arguments presented by the lawsuit in question, and asks the Court to approve this measure, in which case the CEC, as the defendant, will had to revise the lists of political parties, so that they are in accordance with the following provisions, Law no. 05/L-020 on Gender Equality, Article 6, Paragraph 8: "Equal gender representation in all legislative, executive and judicial bodies and other public institutions is achieved when a minimum representation of fifty percent (50%) is ensured for each gender, including their management and decision-making bodies'. Article 14: "Political parties with their acts are obliged to implement measures for the promotion of equal participation of men and women in the organs and bodies of the parties, in accordance with the provisions of Article 6 of this law."

The Law on Gender Equality was approved by the Assembly of Kosovo in 2015, while the CEC after that organized with the same law that it currently applies two electoral processes, the parliamentary and local elections in 2017.
