In the dialogue, it is also necessary to include the Bosniaks of Kosovo

Regarding the statement of the Prime Minister of the Republic of Kosovo, Albin Kurti, after the meeting regarding the dialogue in Brussels

A few years ago, during the wider debate in the Government, in the Parliament and in the media in the Republic of Kosovo regarding the Kosovo-Serbia dialogue, I published an article in several media in both languages ​​- Bosnian and Albanian - with the title: "It is necessary for Kosovo Bosniaks to participate in the dialogue process".

Meanwhile, as elected representatives of the Bosnian national community from the Vakat coalition, engaged in the institutions of the Republic of Kosovo, we requested in writing and with direct explanations from the then Prime Minister Haradinaj and the EU Office our participation in the dialogue.

We also made our suggestions to Prime Minister Avdullah Hoti about some details (published) from the dialogue during the short term of the previous Government.

In the beginning, during the above-mentioned mandate of the Government of Prime Minister Haradinaj, in principle the good will was expressed to accept the participation of Bosniaks in the dialogue.

But, a little later in the Assembly, the draft law did not provide for it, so only our intervention and request (from the DSB party - Vakat coalition) directly to the Prime Minister and the Speaker of the Assembly, and the deputy of Vakat, Bahrim Shabani - who in that moment was the 61st deputy for the necessary quorum to vote on the Law on the state delegation for dialogue - at the last moment our request was approved and in the legal text regarding the composition of the delegation the word was added and voted: ".. . and a representative of the Bosnian community".

This law was later declared unconstitutional by the Constitutional Court, but what matters is what was achieved.

So, it was achieved that the then political leadership of Kosovo understood the need to include the Bosniaks in the dialogue, for the simple reason that it was not one of our demands such as "come on Alija, let there be more soldiers!", but due to the specific needs, among others, for the unfavorable and endangered rights of the members of the Bosniak community in the municipalities in the north of Kosovo.

Let us remind you that there are several murders and serious injuries of Bosniaks still undetected since 2010, and a little later. There, Bosnians do not even have the right to education in their mother tongue, while a large number of them in the meantime settled in Novi-Pazar, Sarajevo or, most of them in the diaspora, especially those who once lived in the municipalities of Mitrovica, in Leposavić .

In that part of Kosovo, the minority Bosniak people are also threatened with freedom of expression - in the full sense of the word, not to mention free voting, which is directly controlled in all past elections, especially the last one.

In this regard, it is necessary for the Prime Minister of Kosovo and the mediators of the EU, the USA and the embassies to communicate with all representatives of the Bosniaks, especially those who are winners in the elections in the Bosniak community.

It also helps the competent Bosnian institutions and individuals to make a short study that will really give a cross-section of the national, political and legal situation of the Bosnian population in these four municipalities in the north, from the entry of KFOR into Kosovo in June 1999 to date.

The text of the study should also offer proposals for solutions, in accordance with the overall Bosnian national goals, the Constitution of Kosovo and positive practice.

Regarding these four points, which were emphasized by the Prime Minister of Kosovo Mr. Kurti, proposed to the Serbian delegation, immediately after the meeting in Brussels, on June 15, is interesting, among other things (for us Bosniaks and other non-majority communities), the proposal to "form a national council of the Serbian community..."

So, there is something to "follow" and to participate in the dialogue even from the Bosnian community.

Of course, the participation of Bosniaks in the dialogue does not mean that they are present directly with the Prime Minister of Kosovo and his entourage in Brussels or elsewhere, but it is important that they are regularly involved and informed by the representatives of Kosovo.

I would like to mention once again: the legitimacy for this participation on behalf of the Bosniaks of Kosovo lies above all with those who were elected by this minority people with a majority of votes (and in the last elections.)

(This remark is important, because we Bosnians know that before 1999, "some representatives" were "elected" "from there", which is a real danger even now of "zen zeri" for the Bosnian community by someone without the will of the people).

Otherwise, the general Bosnian national interest is that neither their position nor the position of other non-majority communities, in the Constitution and relevant laws of the Republic of Kosovo - should be fundamentally changed in case of "opening" of the Constitution of the Republic of Kosovo or in case of changing the provisions of some laws, which are of particular interest to non-majority communities.

And in the case of the "opening" of the Constitution, what some of us Bosniaks have requested and what the current MPs should request on behalf of this community - is to correct the error in Article 5 of the Constitution and to write the third Bosnian language in a row, and not the fourth, as it is now!

This was one of the main omissions of the then Bosnian deputies in 2008 during the approval and voting of the Constitution of the Republic of Kosovo, ie. a very incorrect procedure of those others who prioritized the Turkish language with that draft Constitution.

In this case, apart from the injustices that are often done to the Bosnian language, ie. towards the Bosniaks, in the linguistic order of the publication of some official documents or inscriptions (with the "justification by the letter of the Constitution"), there is a contradiction in the Constitution, which may also be evidence of abuse in the mentioned "justification", because, apart from the fact that it was always known that Bosniaks are more numerous than Turks in Kosovo, another article of the Constitution clearly confirms this, which the drafters of the Constitution also knew - through the article that sets the number of reserved/guaranteed seats, where it says - three (3) for the Bosnian community and two (2) deputies for the Turkish community. (?!)

Also, a little earlier than the year of the adoption of the Constitution, a big concession was made by the then Bosnian representatives during the adoption of the Law on the Use of Languages, where only the Turkish language was given the status of "traditional" language and only for the Municipality of Prizren , which is good, because this consequently made a legal privilege not to take into account the population of this community of five (5) percent, for the recognition of the official status of the Turkish language in the Municipality of Prizren.

Namely, there was room for the registration of the Bosnian language as "traditional", not only for the Municipality of Prizren, but also in other municipalities, especially for Mitrovica, which is a well-known historical destination for the Bosnian people.

For this unfavorable status of the Bosnian language, efforts should be made to change it in a positive direction, in case of a proposal to change the Law on the Use of Languages, which normally requires votes from the deputies of the majority people, the Albanians, and the world from a number of the non-majority community, that is, also from the three MPs in the guaranteed Bosnian seats.

Since we mentioned Mitrovica, as one of the cities where Bosniaks and the majority of the Albanian people have been present for centuries, unlike some other municipalities in the Republic of Kosovo - where their statutes regulate the use of the Bosnian language in accordance with the law, the Bosnian language in the municipal statute in the southern part of Mitrovica, where the Albanian majority is indisputable, still does not have a clear legal status of the "language in use", although we have emphasized this several times!

Also, Kosovo Bosniaks have no intention of giving up the decentralization of the Municipality, especially Reça, which has been promised and pushed by all Kosovo governments from 2008 onwards, because, unfortunately for the Bosniaks, this issue was avoided since to be directly included in the Plan of president Ahtisaari, in Vienna, which was the basis of the constitutional and legal order of the Republic of Kosovo.

And that regular Bosnian demand for decentralization - which is legal, legitimate and vital, from the Bosnian side had nothing to do with the formation or not of anyone's "associations of municipalities".
