Miftaraj: KPK abuses the independence granted by the Constitution

Ehat Miftaraj, executive director at the Kosovo Institute for Justice (IKD), in the show "Tempus" on KTV, said that the Kosovo Prosecutorial Council (KPK) misuses the independence given to it by the Constitution.

"We have repeatedly said that the Prosecution Council of Kosovo, in many cases, is abusing the independence provided by the Constitution. It means that the independence that the Constitution has given in important processes, which was also mentioned by the prosecutor Bahri, in recruitment, in the advancement of judges, in disciplining judges, is not what we are seeing in practice. We, civil society organizations, monitored the process for Chief State Prosecutor and unfortunately it turned out again that the KPK was not able to do this process based on the law, on the basis of the Constitution, on the basis of the procedures it has adopted, the rules which has been approved by the Prosecution Council of Kosovo itself", Miftaraj said.

He added that this process was disputed by the American Embassy, ​​the EU Office, the German Embassy, ​​and became part of the Progress Report.

"There must come a moment when the Prosecution Council, as a mechanism, as a collegial body, must be more open to the public, to criticism", stressed Miftaraj.
