Fejzullahu: The preparation of new judges and prosecutors, the main objective of the Academy of Law

Enver Fejzullahu, director of the Academy of Law, in the show "Tempus" said that the preparation of new judges and prosecutors, through organized training, remains the main objective of the Academy of Law.

Fejzullahu emphasized that a great deal of work has been done in recent years, where in 2020 and 2021 five generations were trained as part of the initial training.

He said that 180 new judges and prosecutors have been trained in the initial training for the last four years.
"If we take as a whole only the initial training for the last four years, around 180 new judges and prosecutors have been trained who are recruited by the KJK and the KPK, which is a percentage of the first instance of the Basic Courts, somewhere around 50% of all the judges. The other part, of course, is continuous training, which is for judges with a permanent mandate, as well as for prosecutors with a permanent mandate, as well as other staff from the civil service", said Fejzullahu.

The Director of the Academy of Law said that for the last three years, 565 one-day and two-day training activities have been carried out, with the participation of 12 people, including judges, prosecutors and professional associates.

Also, he said that recently there is a special program for associates and legal officers, in order to provide them with a basic training, that according to him, each associate who is recruited will have the opportunity to attend training that will enabled them.

Also, Fejzullahu announced that training for the administrative staff is part of this program.
 


Fejzullahu: About 80% of the trainings organized by the Academy of Law are financed by donors

Enver Fejzullahu, director of the Academy of Law, said that most of the trainings of the Academy of Law (about 80-90%) are financed by donors.

"565 training activities, maybe they were one-two-day, there are some three-day ones, 12 thousand 60 people. 80 to 90% of these activities are financed by donors, not from our budget", said Fejzullahu.

Invited to the show "Tempus" on KTV, the director of the Academy of Law said that the budget is sufficient to implement the training program, but that they are not satisfied with the training programs.

"Can the Academy do something more? Yes. Do we have a chance? No", said Fejzullahu.

"We have a budget that is actually from previous years or from 2019, it is the same. The basis of the budget is the same. Such a budget does not give us the opportunity to do more long-term development planning", said Fejzullahu.

According to him, this is in terms of professional development, as he emphasized the need to see how the legislation is implemented in other countries.

"The most successful, qualitative trainings are when judges learn from judges. We have many legislative innovations in our legislation, but in terms of its implementation, we should more or less have an opportunity to see how they are implemented in other countries", he said.

According to him, a study visit to the European Court of Human Rights should be carried out, for the Supreme Court, but due to the lack of budget they could not do it.

In 2024, Fejzullahu said that their request was to have 1 million and 400 thousand euros budget for the Academy of Law. From them, he said that they received 800 thousand euros from the budget, where the rest was covered by donors.

According to him, only this year the cost for the initial training was 518 thousand euros, i.e. training which is 12 months.

He said that they try to adapt the training program to the needs of the participants, and he emphasized that they address legal issues that are identified.

"We have about 12 different mechanisms that we take. We receive information, data, analyze them through working groups or through tables with KJK and KPK and identify what the priorities are. The needs are great, the opportunities are small, but it offers and fulfills all the needs that are presented", said Fejzullahu.

On the other hand, Fejzullah Rexhepi, president of the Supreme Court, said that they are trying to make the training program for new judges and prosecutors as practical as possible, so that they will then be able to exercise their responsibilities.

"Actually, the program of the Academy of Law, regarding the initial program for both judges and new prosecutors, is done in coordination with the Judicial Council and the Prosecutorial Council. We are constantly trying to include all those topics that are of interest to judges and prosecutors in their daily work. We are trying to make the program as practical as possible so that when they go to work, they will be able to exercise their responsibilities", said Rexhepi.

He said that there has been continuous evolution of the program for both judges and beginning prosecutors.

"We are constantly trying to innovate. During the program for judges this year, we have introduced it as an innovation, in almost every module there is the simulation of judgments, of trials in courtrooms, where judges are faced with different roles, which they will constantly face in court sessions. , said Rexhepi.


Fejzullahu: Completion-amendment of the Law on the Academy of Law has made progress since the approach it had at the beginning

Enver Fejzullahu, director of the Academy of Law, said that the addition-amendment of the Law on the Academy of Law has made progress since the approach it had at the beginning.

"I don't know what the latest version is, but I know that there is progress in the last meeting of the working group from the earlier comments that were made or from the approach that was taken. It means we have preserved the composition of the Governing Council, this is very important. The line of accountability is, as mentioned here, the issue of who the Academy is accountable to. We have given it both as a reaction and as a comment if this Governing Council consists of the most eminent members of the justice system. However, what we have tried to preserve is the ex-officio members who are already on the board. This strengthens the Governing Council, the Academy of Law", said Fejzullahu.

However, he emphasized that there has been progress since the beginning of the working groups that have been, with the last group.

"We still hope it will be a solution, a supplement/change that addresses our demands and needs," he said.
The Director of the Academy of Law said in "Tempus" that the training methodology has been changed, mainly all the training modules are handled, developed, organized in the form of tables.

"We no longer have classic modules or trainings since they were held before, now we mainly have professional debates that take place", continued Fejzullahu.

He said that the addition-amendment of the law should be as good as possible in terms of the opportunity it gives the Academy to develop as a professional institution.

"It is not an institution or an executive agency, if this also reflects on the budget, the budget when planned and allocated to the Academy is like an executive agency. The Academy of Law is a purely professional institution, it means that this is what is very important, even the addition-amendment of the law must go in that vision, in that line", said Fejzullahu.

Meanwhile, Gzim Shala from IKD said that the first draft of this law tried to politicize the Academy to the extreme. He said that they have given their comments on this draft, but that they have not seen the actual draft yet.
