Lawyer Yll Zekaj said that Prime Minister Albin Kurti and his subordinates are trying to capture the justice system by calling for its destruction.

Initially, Zekaj said that the justice system has been fragile and according to him the Prime Minister has found the weak point to attack this system for its populism among the citizens.

"Even so, the justice system has been a fragile system, inherited with a large number of cases, an obvious lack of professionalism, then the influences of the executive have deepened the mistrust of the citizens. I believe this was also the cause of the Prime Minister, why he found the weakest point in the system to attack and perhaps to take this populism to the mass of the citizens", said Zekaj in "Tempus".

Lawyer Zekaj said that the daily accusations of the Prime Minister and his subordinates only weaken citizens' faith in the justice system.

"We have also seen the international reports, and the reports of the American Embassy and other embassies, which in fact have openly declared about a captured system such as the justice system, especially the part of the prosecutorial system, and this is exactly where Prime Minister Kurti attacked the tendency to reform this prosecutorial system, but in what to free it from an old system and capture it from a new system. This is a reflection that can be seen in the justice system in the Republic of Kosovo. Miftaraj: VV is taking failed people from other parties, made a scandalous draft of the Strategy

Ehat Miftaraj, executive director at the Kosovo Institute for Justice (IKD), said that the Vetëvendosje Movement is taking failed people from other political parties and that it has made a scandalous draft for the Anti-Corruption Strategy.

Miftaraj said this on Monday in the show "Tempus" on KTV, adding that when these people were in other parties, they were not close to the parties when policies and laws were drafted.

"There are several factors that have led us to such a situation. The first is: Without a doubt, the Vetëvendosje Movement is unfortunately taking people from the PDK, the AAK, the LDK who have been failed people in these parties, who at the time when these parties were governing, it is not that they being close to the party to draft policies and laws. It means, if they take the Anti-Corruption Strategy today, it is led by a person who was an advisor to Abelard Tahir and the same person leads the working group today even though she is a political advisor, we are talking about the Anti-Corruption Strategy", said Miftaraj.

He also added that it is not logical for someone to call himself a lawyer and make a weak document like the Anti-Corruption Strategy Draft was according to him.

"If we look at the first draft, the second draft of this Strategy that was drawn up, it means it is a scandalous draft. It is a draft that we as IKD have given comments twice from 10-12 pages. It means, there is no logic that someone with a lawyer's title, with such a long experience and with such a weak document that they are the alarm as the EU Office, as the American Embassy, ​​as all the international partners with the draft of this strategy", said Miftaraj.

The executive director of IKD added that there was arrogance especially from the leadership of the working group in this Strategy.

"It means factor number two is that they have such excessive arrogance that the same adviser in the working group for Strategy tells the working group, which includes members of civil society, international partners, that if you want to do the strategy, you go out and win 50 % of votes. Bunjaku: I am in doubt whether the Prime Minister wants to "become" a judge or a prosecutor

Viola Bunjaku, researcher at the FOL Movement, said that based on all the criticisms of the justice system, she is unsure whether the Prime Minister wants to "become" a judge or a prosecutor.

"Because every time the prosecution makes a mistake, the Prime Minister or the Minister are the ones who criticize the prosecutorial system and praise the judicial system, while every time the judicial system makes a mistake, the Minister and the Prime Minister turn to the side of the judicial system and praise for the decision, while criticizing the prosecution for the conducted investigations", said Bunjaku.

She said that we cannot say that we have separate powers when we constantly have a Prime Minister and an executive who constantly criticizes the prosecutorial system and the judicial system.

"Obviously, they only do their work by referring to the Constitution and other legal acts.

Zekaj: Failure on every count, more damage than improvement in the justice system

Lawyer Yll Zekaj said that they do not see any change in the justice system thanks to the initiatives of the current Government. According to him, we have failure in every point of this government program, even more damage than improvement in the justice system.

"Absolutely, all practitioners of the law have applauded all the initiatives of this Government since the time it was in opposition and their program for government which has been employment and the rule of law, due to the legitimate aim of improving the justice system ", said Zekaj in "Tempus".

He said that the justice system was in a general mess, there was a need for change, and for this he said that they welcomed every initiative related to justice reform.

Zekaj said that there is a large number of cases that are waiting to receive an epilogue, but that are not seeing any change thanks to the Government's initiatives.

"Starting with reforms in the prosecutorial system, also from the Bureau for Confiscation of Assets, wishing to see a better situation regarding corruption, organized crime and others, what was like 3 and a half years ago, almost in the year during the last period of governance, we do not see any change in the justice system thanks to these government initiatives, that is, we have failure at every point of this government program exclusively in terms of the rule of law, and we have more damage to the justice system than improvement of this system" , said lawyer Zekaj. / Oath of Justice


Miftaraj: They created an "enemy" of the Constitution to justify the failures in the reforms

Ehat Miftaraj, executive director at the Kosovo Institute for Justice (IKD), in the show "Tempus" on KTV, said that the Government of Kosovo has created the Constitutional Court as an 'enemy' to justify the failures in reforms.

Before that, Miftaraj said that this Government has serious problems in the professionalism to draft laws and policies in accordance with the Constitution.

"It is understandable that this Government is having serious problems in professionalism to draft laws, policies that are in accordance with the Constitution. If this Government had the political will to address the comments of the Venice Commission either to Vetting, or to the Law on the KPK, or to the Bureau, I am sure that it would come up with a law which would be able to passed the filters of the Constitutional Court", said Miftaraj.

Bugaqku: Most of the essential movements for the implementation of justice reform have failed

Vullnet Bugaqku, senior researcher at the Democratic Institute of Kosovo (KDI), speaking about the justice reform, said that the recent results, the timing and the approach of the majority leave much to be desired for the achieved effects. He said that most essential movements for justice reform have failed.

Invited to the show "Tempus" on KTV, Bugaqku said that civil society and international partners are for justice reform. However, the will of the political parties in the campaign and of the majority during the power has also been manifested on this issue.
