Both parties have requested the reversal of the verdict against Jelena Djukanovic, who was sentenced to six years in prison by the Basic Court in Pristina for espionage. In Friday's session, the Special Prosecution through its appeal requested a higher sentence, while the defense requested that Djukanovic be acquitted of the charges.
A hearing was held at the Court of Appeals, after both the Special Prosecution Office and the defense appealed against the decision of the Basic Court in Pristina, by which Jelena Djukanović was sentenced to six years in prison for espionage in favor of Serbia.
The prosecution, in its closing argument, had requested 25 years in prison.
At Friday's hearing at the Court of Appeals, representatives of the prosecution were not present.
However, part of the Prosecution's appeal was read by the referring judge, Vaton Dërguti.
"In the first point, he proposed that the appeal of the Special Prosecution be approved as well-founded and the verdict be amended in relation to the sanctions of the Criminal Code in such a way that the accused for this criminal offense be sentenced to a higher prison sentence. While in the second point, he proposed that the appeal of the accused's defense attorney, attorney Predrag Milković, be rejected as unfounded," said Dërguti.
Djukanovic's defense has also filed an appeal.
Her lawyer, Predrag Milković, claimed that there were violations of procedural provisions, incorrect determination of the factual situation and incorrect application of substantive law in the process.
He has requested that Djukanovic be acquitted of the charges, the first-instance verdict be annulled, and the case be returned for retrial.
"The defense stands by the complaint that the search can only be carried out according to a court decision, no other way... The prosecution has seized the phone legally, but it did not have access to the contents of the phone legally," said Milkovic.
The Special Prosecution Office filed an indictment against Djukanovic on September 2, 2025. It held her responsible for repeated actions that constitute active assistance to the Serbian intelligence service, BIA, by providing it with sensitive data, documents and information, obtained during the exercise of her official duty within the framework of the OSCE mission.
