Krivaq's life sentence for the murder of Marigona Osmani is confirmed

The Court of Appeal on Wednesday upheld the verdict of the Basic Court of Ferizaj, confirming the life sentence for Dardan Krivaqë, the main accused in the murder of Marigona Osmani. The appeal also confirmed the 15-year prison sentence for Arbër Sejdiu, who is accused of aiding and abetting aggravated murder.

The Court of Appeal has confirmed the life imprisonment sentence against Dardan Krivaqë, who was found guilty of the murder of 18-year-old Marigona Osmani in 2021.

In the Appeals Office's announcement on Wednesday, it was announced that in addition to Krivaqë's conviction for the criminal offense of "aggravated murder", the 15-year prison sentence against Arbër Sejdiu, who was convicted of the criminal offense of "assistance in the commission of aggravated murder", was also confirmed.

Marigona Osmani (18) was murdered on August 22, 2021, in Krivaqë's apartment in the city of Ferizaj.

Krivaqa and Sejdiu were initially convicted for her murder in August 2023. However, after accepting several defense appeals, the Court of Appeals sent the case back for a retrial. 

"The Court of Appeal of Kosovo has rejected as unfounded the appeals of the Basic Prosecution Office in Ferizaj, the representatives of the injured parties MO and VO and the defense attorneys of the accused DK and AS, confirming the verdict of the Basic Court in Ferizaj - Department for Serious Crimes," the Appeals Office announced.

This court has deemed the appeal claims of the Prosecution and the defendants' defense attorneys regarding essential violations of the provisions of criminal procedure unfounded.

"The trial panel assesses that the first instance court has analyzed all the evidence processed during the main trial and has presented its conclusions regarding this evidence, which it assesses as fair, objective and lawful. Regarding the appeal claims regarding the incorrect and incomplete determination of the factual situation, the trial panel finds that the first instance court has correctly and completely determined the factual situation, because the evidence administered during the main trial has established that the defendants DK and AS committed the aforementioned criminal offenses, for which they were found guilty," the Court's announcement states.

Regarding the imposition of a life sentence for Krivaqë and a 15-year prison sentence for Sejdiu, the Court of Appeals found that it is an adequate sentence and based on the law.

The Basic Court in Ferizaj issued the verdicts for Krivaqë and Sejdiu on August 4, 2023, but the case was returned for retrial with the approval of the Court of Appeal, and on July 29, 2024, this court again found Krivaqë guilty, sentencing him to life imprisonment. 

According to the indictment, Dardan Krivaqa on August 21, 2021, at around 10:14, in his apartment and without her consent, forced Marigona Osmani to have sexual intercourse and abused and mistreated her in various ways. According to the indictment, the Krivaqas of Sejdiu, a day later, deprived Marigona Osmani of her life, in an attempt to hide the criminal act of rape.
