EC to propose veto waiver for new EU member states

Përderisa për Malin e Zi dhe Shqipërinë synohet përmbyllja e suksesshme e negociatave të anëtarësimit, pasi këto dy vende kanë avancuar më së shumti, për vendet tjera synohet një fazë kalimtare gjatë së cilës do të ndiqej synimi i integrimit gradual në ato fusha ku do t’i përmbushnin kriteret pa pasur nevojë për të pritur anëtarësimin formal në Bashkimin Evropian

Komisioni Evropian javën që vjen, më saktësisht më 6 tetor, do të miratojë një raport për politikën e zgjerimit ku do të bëjë një analizë të gjerë dhe precize të këtij procesi të rëndësishëm dhe sfidave që ka për BE-në, por edhe të japë disa rekomandime për hapat që duhet të ndërmerren për ta bërë zgjerimin me sukses të dyanshëm.

Sipas propozimeve të komisionit të cilat do t’i prezantohen BE-së për vendet e reja anëtare do të vendosen disa kufizime, së paku në një fazë të kufizuar kohore. Kjo do të përfshinte përkohësisht edhe mohimin e së drejtës së vetos e në raste ekstreme, nëse do të ketë dëshmi se vendi i ri anëtar nuk i respekton vlerat themelore të BE-së, do të mund të çonte edhe deri te heqja e të drejtës së votës.

BE-ja shpesh në të kaluarën ka pasur raste kur vendimet janë bllokuar vetëm nga një shtet anëtar. Kjo ka ndodhur edhe në rastet e sanksioneve ndaj ndonjë shteti apo në çështjet tjera të politikës së jashtme.

Përderisa do të mohohej përkohësisht e të drejtat e vetos për vendet e reja anëtare, Komisioni propozon që të zgjerohet fusha e vendimmarrjes me shumicë të kualifikuar në përgjithësi që do të hiqte të drejtën e vetos edhe për vendet e tashme anëtare. Kjo do ta bënte BE-në më të aftë për të vepruar ndërkohë që nuk do të prekte traktatet themelore të bllokut. Për ndryshimin e traktateve është i nevojshëm pajtimi i të gjitha vendeve anëtare dhe pastaj ratifikimi i këtyre ndryshimeve në Parlamentet e secilit vend, diçka që është bërë shumë joreale.

The so-called "safeguard clauses" the EU would also decide on in the financial, institutional, common market, internal affairs and several other areas. But these would not be the same for each new member state because, according to the European Commission's proposal, they would be designed separately for each candidate, taking into account their specificities.

Montenegro looks set to be the first new member state in the future. It will not pose any challenge to the EU in any respect. For an EU citizen, Montenegro's accession would cost less than 1 euro per year. But things would be very different with other countries, especially if Ukraine were next.

The European Commission believes that one practical change should be the transition to qualified majority voting instead of unanimity. The Commission even considers that even now, according to the Treaty, consensus is only required for the admission of a new member state, while the Council is in practice using consensus at every step, including the opening and closing of chapters. This, the European Commission believes, could be changed by a Council decision without the need to amend the EU treaties.

The European Commission is expected to propose moving from consensus to qualified majority voting in the accession negotiations process at intermediate stages, while maintaining consensus for the final decision. It will also require new member states to pledge not to use their veto power in further enlargement.

While the aim is for Montenegro and Albania to successfully conclude their accession negotiations, as these two countries have advanced the most, for the other countries a transitional phase is intended, during which the aim of gradual integration would be pursued in those areas where they would meet the criteria without having to wait for formal membership in the European Union. 

"There is no single model of gradual integration. The most appropriate path depends on the level of preparation of each country in the accession negotiations process and the sector in which early participation would bring benefits. For Montenegro and Albania, which have advanced well in the accession process, the priority remains the successful conclusion of negotiations. For other candidate countries, gradual integration offers earlier means for advancing economic convergence, strengthening political cooperation and delivering tangible benefits alongside continued reforms," ​​the draft states. 

So even gradual integration will not be unconditional and it does not replace formal EU membership in the future.

EU leaders will discuss this proposal at their summit in Brussels on October 15, while the enlargement package and progress reports for candidate countries and Kosovo, which is the only non-candidate in this process, will be approved and published at the end of October.
