Through the first instance verdict, the prosecution's accusation against Andi Pajaziti, accused of "murder committed in a state of severe mental shock", when he fired bullets at Kastriot Ramadani, was not proven. He was acquitted of this charge, after the court assessed that the act was committed in self-defense. And, the family members of the victim Ramadani have announced that they have lost faith in both the prosecution and the court.
Andi Pajaziti was acquitted on Friday of charges for the murder of Kastriot Ramadani, on August 4, 2023, at the "Bon Vivant" bar in Pristina.
The prosecution has charged him with "murder committed in a state of severe mental shock" during a physical conflict with the victim, but the judge, Eroll Gashi, has assessed that the act was committed in self-defense.
"He is acquitted of this provision of the indictment, because there are circumstances that exclude criminal liability, namely the defendant's actions are within the framework of necessary defense," the judge said.
Gashi justified the decision, saying that the victim Ramadani shot the defendant Pajaziti with a firearm, and previously hit him in the head with a glass bottle.
"Due to the strong mental shock and through no fault of his own, without thinking about the consequences, he takes the gun out of his belt, from his right side, and at the same time, the late Kastriot Ramadani also takes the gun out of his belt and both shoot at each other," he stated.

Family members of victim Ramadani have not participated in the trial since December 10, when they announced that they had lost faith in both the prosecution and the court.
And, Pajaziti was not acquitted of all charges. He was sentenced to two years in prison for illegal possession of weapons.
"Andi Pajaziti owned, in violation of the applicable law on weapons, the 'Smith' type 9 millimeter caliber weapon with which he struck the injured party," said Judge Gashi.
During the announcement of the verdict, the role of Dukagjin Lekaj in this incident was also elaborated, and he is currently on the run. According to the announced verdict, he was the first to contact Pajaziti.

And, the court has instructed the six injured parties who suffered injuries mainly from the firearm used by Andi Pajaziti to exercise their right to compensation through a civil dispute.
