Durmishi is interviewed as a suspect for the 40-million contract

As a suspect, on Wednesday, he was interviewed by a special prosecutor, Deputy Minister of Infrastructure and Environment, Hysen Durmishi. After the interview, he said that the PRB decided in favor of the Ministry, but in the same decision this body found that the contract was signed in violation of the law

The Deputy Minister of Infrastructure and Environment, Hysen Durmishi, was interviewed on Wednesday by the Special Prosecutor's Office as a suspect for the tender of around 40 million euros for the construction of the Pristina-Podujevë road.

He confirmed that he was interviewed, but emphasized that he is innocent.

"Today I responded to the invitation of the Special Prosecutor's Office. I was invited as a suspect in the case of the Pristina-Podujevo road construction project. This is mainly an initial phase and the prosecutor's questions were clarifying questions which I clarified almost all of which the prosecutor had, to prove that the process for the Pristina-Podujevo road was a regular process and that the works are being carried out there the dynamic that we have planned and somehow I explained to the prosecutor my complete purity in this whole process", said Deputy Minister Durmishi, after leaving the interview. "It is a matter of a criminal complaint made by a complaining economic operator at the time when these contracts were signed, which is totally unfounded."

He said that the decisions were also confirmed by the Procurement Review Body (PRB).

"There are also decisions of the PRB, documents which are public and which prove our purity in this whole process. Therefore, it was simply some clarifications from the prosecutor which he received and now we are waiting", said Durmishi.

The contract for which suspicions have been raised against Deputy Minister Durmishi was signed at the time when there was a complaint in the PRB. Such a thing is contrary to the Public Procurement Law.

Although Durmishi has been referred to the decision of the PRB, that very decision says that the Ministry should not have signed that contract before the review of the complaints was completed.

Initially, such a finding was made by the examining expert.

"The expert has come to the conclusion that for this procurement activity the contracts have already been signed and the works have begun, taking into account the damages and the public interest, which he thinks is greater if the contract is canceled by this action, than re-evaluating and granting access for the complaining Economic Operator", the PRB document states. "Therefore, as such, based on this fact, the claim of the complaining Economic Operator regarding the violations mentioned above is considered to be well-founded, which complaint it qualifies as partially well-founded, while recommending the review panel that the decision of to the Contracting Authority to remain in force".

With the same legal basis, the PRB decided in favor of the decision of the Ministry, but concluded that in this case the officials of this institution violated the law.
