The Serbian list must be certified for participation in the February 9 elections, as it has met the legal criteria, according to the decision of the Electoral Panel for Complaints and Submissions received on Wednesday. The Serbian List complained to this institution a day ago, while the CEC's decision of December 23 was accompanied by numerous criticisms.
The Electoral Panel for Complaints and Submissions has approved the complaint of the Serbian List for non-certification by the Central Election Commission. Thus, PZAP rejected the decision of the CEC, which had decided not to certify this party.
According to the reasoning of this mechanism, Lista Serbe with its application to participate in the February 9 elections has fulfilled all the required legal criteria.

Letter to the Reader — Why We're Asking for Your Support Contribute"In this particular case, the Panel confirmed that Lista Serbe submitted the completed application, in compliance, based on articles 16 and 17 of the LZP, and the CEC is obliged to certify any political entity that meets the prerequisites legal as filled out in this case by the political entity Lista Serbe, for which the same has been recommended for certification by the Office for Registration, Certification and Financial Control of political entities in CEC", it is stated in the decision of the PZAP.
The Electoral Panel for Complaints and Submissions has said that from the voting process for the non-certification of the Serbian List, there was no consensus as required, and therefore there was no decision on this case.
It is further stated that the notification is also contrary to the legal provisions in force, therefore the CEC is ordered to implement the decision of the PZAP.
"The notification of the Central Electoral Commission, dated 23.12.2024, is cancelled, and the CEC is ordered to certify the political entity Lista Serbe and the candidates of this political entity, according to the recommendation of the Office for Registration, Certification and Financial Control of political entities in the CEC of dated 22.12.2024, for the elections for the Assembly of the Republic of Kosovo to be held on February 9 2025", it was said in the decision published by PZAP.
After this decision, the spokesperson of the Central Election Commission (CEC), Valmir Elezi, said that the CEC will wait for the legal deadline for a complaint against him, before putting this issue on the agenda.
"In the decision of the PZAP, there is a legal advice, according to which an appeal against it to the Supreme Court is allowed, within 48 hours from the moment of the decision. Therefore, the CEC will wait for the completion of the legal procedures before assigning this issue to the agenda", declared Elezi.
The non-certification of the Serbian List by the CEC has been criticized by experts on the electoral system and by internationals. Her decision was considered politically influenced.
