Albanological Institute in Court against the decision that leaves it without a director

Security measure and rejection of the decision of the acting Minister of Education, Science, Technology and Innovation, is the request with which the Albanological Institute of Pristina is expected to address the Basic Court in Pristina today (Wednesday). A step like this is the next act of the director's drama, the origin of which is the decision of MASHTI that leaves this institution without a director, but which the acting Minister of Education, Arbërie Nagavci, requests that the Special Prosecution of Kosovo examine

Since it came on the scene, the drama of the director of the Albanological Institute of Pristina has not been a week without unfolding at least one act. The next is the one in which the IAP has warned again that it will address the Court. It will do this today (Wednesday). In fact, this step also comes as a response to the Ministry of Education, Science, Technology and Innovation, which exactly a week ago, last Wednesday, had announced that it had notified the Special Prosecution of Kosovo about this case. It was the acting minister, Arbërie Nagavci, who addressed the institution through a letter – which in its mandate mainly deals with serious cases – informing it “of the legal violations” and requested “the initiation of criminal proceedings in relation to the process of selecting the director”. The rest was accusations, the IAP appeared surprised by the approach of MASHTI, also mentioning the threat and attempted intimidation. 

If the Prosecution has received the request, it has not responded for six days. 

"We will address the Basic Court in Pristina," the OIK confirmed late Tuesday. The request is clear. 

"A security measure and a rejection of the decision of the acting Minister of Education, Science, Technology and Innovation will be requested," the IAP explained to KOHĀ. 

The decision of the acting minister, Nagavci, to annul the decision to appoint Naim Berisha as director of the OIK is the fuse of the clashes between the two institutions. It was made public on Facebook, followed by counter-responses there, but the clashes deepened even more when the Special Prosecution of Kosovo was mentioned.

On the afternoon of Monday, January 26, almost two months after the election of the director by the IAK Steering Council, it was the acting minister herself who filled the vacancy removed from her cabinet. "The decision with no. IAK/127, dated 04.12.2025, for the election of the director of the Institute of Albanology of Kosovo is annulled. The Steering Council is obliged, without the expiry of the legal deadline of two (2) years, from the time the Institute has not elected a director, excluding the time from the election of the director until the cancellation of the competition, to transfer the mandate of the director to the acting director from among the employees of the Institute, to notify the Ministry of the announcement of a new competition for the director of the Institute, and to take into account the recommendations of the Ministry regarding the conditions and criteria of the competition for the internationalization of science", it is written in the first point of the decision. In the second point, the Steering Council of the Institute of Albanology of Pristina is obliged to take the necessary actions to comply with the legislation in force. 

Since the decision was announced, the OI Steering Council has indicated that it will not comply with the decision. This was followed by the next posting of the acting minister to the Special Prosecution Office. 

"Among other things, I have informed the Prosecution that the suspects, in violation of their legal duties and responsibilities, have committed at least the following criminal offenses: Abuse of official position or authority, according to Article 414, paragraph 1 of the Criminal Code of the Republic of Kosovo; Violation of rights in labor relations, according to Article 218 of the Criminal Code of the Republic of Kosovo; Complicity, according to Article 31 of the Criminal Code of the Republic of Kosovo," she wrote, but on social networks, after official working hours. 

According to the acting minister of MESTI, based on the reports and official documents received so far, "it has been established that we are dealing with illegal actions aimed at obtaining certain positions and benefits of the position, while not respecting the legal provisions in force and exceeding legal authorizations and powers." 

After this, the IAP's response was even stricter. "Political and public pressure on the Albanological Institute," the IAP had described this post by Minister Nagavci. It responded on social networks.

In a post on her Facebook page, after 16:00 PM, she claimed that she had addressed the Special Prosecution of Kosovo regarding what she describes as 'legal violations and a request to initiate criminal proceedings in connection with the process of selecting the director of the Institute of Albanology'", the post of this scientific institution read. According to the post, the Institute of Albanology, namely its leaders, "feel under public, psychological and political pressure in performing their duties after this surprising action of the acting minister, since a matter that is and should be considered entirely administrative, she intends to cover it with criminal charges".

Whatever the "dress" of the director's case, it has already been referred to justice bodies: to the Ministry of Education, Science, Technology and Innovation, as a case to the Special Prosecutor's Office, to the Pristina Albanological Institute, to the Pristina Basic Court. The next acts will also take place there.
