Murder in Aktash, Parole Panel releases Vesel Bunjaku two years without serving the full sentence

The Parole Panel, consisting of Valdete Daka- chairman and members- Burim Ademi and Besim Zllashi, on July 24, 2024, had decided to release Vesel Bunjak on parole, two years, two months and five days before the end of the sentence. Bunjaku was serving a sentence for the criminal offense of "Aiding in the commission of the criminal offense of serious murder".

Vesel Bunjak was ordered to be detained for 30 days by the Basic Court of Pristina on September 12, 2024 under the suspicion of tampering with evidence in the case of the murder of Premtim Gashi, after the shootout between the "Sekiraqa" and "Gashi" families ” – known as Capat, on September 1 in the “Aktash” neighborhood in Pristina. It is suspected that he had hidden two weapons after the shooting between the two groups.
In the decision of the Panel provided by the "Oath of Justice", it is said that it was decided that Bunjaku would be released from July 29, 2024 and would be under the supervision of the Kosovo Probation Service until September 29, 2026.

Also, with the approval of Bunjak's request for parole, he was obliged to report to the Regional Directorate of the Kosovo Police, namely the Probation Service, within five days from the date of his release from the correctional institution, under certain conditions.

"1. to report regularly to the Probation Service until 29.09.2026; 2. in case of change of residence, notify the Police and the Probation Service; 3. not to attempt to travel abroad without the approval of the Parole Panel; 4. to be more careful with his behavior in the future", states the decision of the PLK.

Initially, in the decision of the Panel, it is noted that Bunjaku was found guilty on November 30, 2018 and sentenced to 5 years and 6 months of imprisonment by the Basic Court in Pristina for the criminal offense "Aiding in the commission of the criminal offense of serious murder" from Article 179, par. 1, point 1.4 and 1.6 related to article 33 of the Criminal Code.

However, the Court of Appeal on March 28, 2019, changed the verdict of the first instance regarding the legal definition of the criminal offense and the decision on the punishment, so that it imposed a prison sentence of 11 years and 6 months and found that in the actions of the convicts have the elements of the criminal offense "Aiding in the commission of the criminal offense of aggravated murder" from article 179, par.1, point 1.6 related to article 33 of the Criminal Code.

Then, it is said that in the Panel session, the report of the professional team of the Kosovo Correctional Service was reviewed and after the evaluation of the data presented in this report.

"In the legal report for the convict, it is confirmed that the convict, the date of the end of the sentence was set on 29.09.2026 and from the calculation of the sentence, it results that from the sentence of 11 years, 6 months, the convict has 2 years, 2 months left. , 5 days, which will be supervised and controlled by the Probation Service of Kosovo", the decision of the Panel states.

The decision states that from the reports compiled by the professional team of the Correctional Center, it results that Bunjaku has shown good behavior, ie there are no records of new disciplinary violations. Also, this team assessed that "the process of resocialization is being achieved".

During the session, the panel found that the convict's request for parole was rejected twice.

"From the preliminary reviews of the requests for conditional release, it appears that the convict has improved his behavior, namely from the first review of the request for conditional release, there are no data on new disciplinary violations. In the data for the realization of the program for the treatment of the convict, it was established that the convict is a user of leave outside the institution", the decision of the Panel states.
During the examination of the request, the Panel also evaluated the promise that Bunjak gave to the officer of the Probation Service that he will cooperate with them until the end of the parole supervision and that with an effective supervision he will easily be re-integrated into family and society in accordance with the law.

In the end, the Panel found that serving the sentence had achieved the purpose of the sentence, as Bunjaku had served more than 2/3 of the sentence as of November 29, 2022.

Therefore, Vesel Bunjaku was released on bail on July 29, 2024.
