One month detention for a person for endangering public traffic

The Basic Court in Prizren has ordered the measure of detention for a duration of thirty days, against the defendant GH, due to the well-founded suspicion that he committed the criminal offense of "endangering public traffic".

According to the Court, the defendant negligently hit the pedestrian with a car, causing bodily injuries.

"On December 01, in the evening hours in Prizren, while driving the vehicle, negligently and in violation of the Law on Public Traffic Rules, he endangered traffic participants and put people's lives at risk, in such a way that the defendant did not adapt the speed of movement to the conditions and circumstances on the road, the same does not give priority to pedestrians who were crossing the pedestrian crossing, where the front part of the right side of the vehicle hits the injured M.Gj., thrown at a distance and while the vehicle is stopped it runs over the victim with the rear wheel on the right side, in which case the victim suffers serious life-threatening injuries, with serious wounds in vital parts of the body, which injuries are found in the medical report", the Court's communique says.

The court has assessed that by staying at liberty the defendant can hide or flee in order to avoid prosecution and criminal liability, also taking into account the manner and circumstances in which the criminal offense is suspected to have been committed, where the defendant in the area where the pedestrian crossings are marked, he drives the car at high speed and endangers the life of the injured party, they justify the decision to assign the measure of detention to the defendant.
