The accused of serious murder, Kemal Mustafa, pleaded not guilty and said that he acted to defend himself out of fear.
Mustafa, who is accused of murdering SM, made this statement on Thursday at the Basic Court in Mitrovica, during the initial hearing where the indictment was read.
"No, I do not accept that I am guilty. I did it to protect myself because at that moment I am yours", declared the accused Mustafa.
Mustafa is accused of stabbing the victim SM 33 times after, according to the indictment, the latter had punched him, demanding sexual intercourse against his will.
After the accused was declared innocent, the judge informed him that within 15 days he has the right to present the opposition to certain evidence in the indictment or request to drop the indictment.
The Basic Prosecutor's Office in Mitrovica filed an indictment against Kemal Mustafa on September 9, 2024.
According to the indictment, Mustafa is charged that on August 11, 2023, around 23:29 p.m. to 23:45 p.m., on "UÇK" street in Bair neighborhood, Mitrovica, inside the yard of the regional hospital, with the aim of depriving SM of his life, he hit SM, with a knife and caused his death.
In the indictment it is stated that while the defendant Mustafa had been together with his minor son AK, collecting cans in the beer container, the now deceased SM had stopped the vehicle and had called the defendant Mustafa, and had told him that went to his vehicle to give him some bottles and some things, whereupon the defendant Mustafa entered the vehicle of the now deceased SM, and they went to the Bair neighborhood and entered the hospital yard, while the defendant Mustafa had now asked the deceased SM why he had sent him there, the same had told him to undress to have sex.
According to the indictment, it is said that the defendant Mustafa refused to have intercourse with the now deceased, who continued to insist and punched the defendant, while the defendant Mustafa stabbed the victim 33 times in the body, caused wounds as a result of which he had died based on the autopsy expertise for the now deceased.
With this, Mustafa is accused of having committed the criminal offense "Aggravated murder" from article 173, paragraph 1, point 1.4 of the Criminal Code of the Republic of Kosovo./BetimipreDrejtsi
