Dardan Krivaqa is sentenced to life imprisonment, Arbër Sejdiu to 15 years

Dardan Krivaqa was sentenced to life imprisonment, while Arbër Sejdiu was sentenced to 15 years in prison, in the retrial for the murder of Marigona Osmani.

The sentence is the same as in the first judgment of the Basic Court in Ferizaj. Even in the retrial, Krivaqa was acquitted of the charge of rape, and Sejdiu of the charge of aiding in the rape.

The chairman of the court, Sahit Krasniqi, said on Monday that the cruelty in accordance with the decision of the Appeal has now been proven because the forensic expert has established that with violence Krivaqa caused Marigona Osmani great and extremely great pain.

The lawyer of Marigona Osmani's family, Gazmend Rexhepi, after the announcement of the verdict, said that he is partially satisfied with the decision.

According to Rexhepi, there is evidence that even Sejdiu should have been sentenced to life imprisonment. 

"I would be even more satisfied if the second convict would also receive the meritorious decision, that is, the lifelong decision. It is the evidence for life imprisonment. We have the proper evidence as well as written. The atrocity that was explained by the trial body was established based on the shooting evidence. It is strange how it was carried out the first time without citing the main facts, the most important ones were not cited. They are the main concrete videos where the deceased had a slow death", said Rexhepi.

On August 4, 2023, the Foundation in Ferizaj sentenced Krivaqa to life imprisonment for aggravated murder and Arbër Sejdiu to 15 years in prison for assisting in the commission of aggravated murder.

The judgment was overturned by the Court of Appeal on February 22, 2024, after complaints from all parties, returning the case to a first-instance retrial.

Krivaqa was acquitted of the charge of rape and Sejdiu of the charge of aiding and abetting rape. Among the violations found by the Appeal, were the fact that the motive "jealousy" was derived from the defendant's own statement in the Forensic Psychiatry and that the cruelty mentioned in the verdict is not something that was proven by the statements of the experts of the Institute of Forensic Medicine ( IML).

The murder of 18-year-old Marigona Osmani on August 21, 2021 shocked public opinion.

In the second hearing of the retrial of Dardan Krivaqa and Arbë Sejdi on June 11, the forensic expert explained that Osmani's death occurred as a result of severe and multiple bodily injuries. The expert's report was opposed by the defense side of Krivaqa, requesting that some examinations be repeated.
