The brotherhood files a complaint, also warns of criminal charges in case of refusal

The basketball club Vëllaznimi has officially filed a complaint with the Kosovo Basketball Federation on Friday. The complaint has been addressed to the FBK's Complaints and Arbitration Commission and concerns the Gjakova club's claim "for incorrect application of material-legal provisions". In the long complaint compiled by the lawyer authorized by KB Vëllaznimi, it is written that it was made "against the official publication of the final table ranking for the regular edition, published by the FBK".

Vëllaznimi claim that they are unjustly in eighth position. According to the complaint, the ranking made by FBK is in contradiction with what is written in the Competition Propositions.

According to the official interpretation of the FBK, Vëllaznimi finished eighth, respectively last in the Super League, and next season should play in the First League.

In fact, there was a lot of uncertainty regarding the last round of the Super League. It was not entirely clear what the ranking would be if three teams had the same points. In the end, this is exactly what happened. Prishtina, Rahoveci 029 and Vëllaznimi had equal points and the ranking, according to FBK, of these three teams is: Prishtina, Rahoveci 029, Vëllaznimi.

The FBK has interpreted the regulations to mean that the ranking is based on the overall results of the mutual matches between the three teams. But Vëllaznimi claims that this is wrong and that only goal difference should have been taken as the basis.

"In the situation where more than two clubs (i.e. at least three clubs) have accumulated the same number of points, the ranking will be determined solely and exclusively on the basis of the difference in points scored in the matches between them. It follows from article 47.1.4 of the Competition Regulations that the first and dominant criterion over all other criteria, in the case where there is a tie in points between at least three clubs, is the difference in points scored between them," it is written in the lengthy justification made in the complaint.

If goal difference alone were taken as the basis, Vëllaznimi would avoid relegation from the Super League and would finish seventh.

The representative of Vëllaznimi wrote that if the complaint is not approved, "then the club will pursue legal avenues through criminal charges against the relevant FBK officials for willful violation of the provisions of the Competition Propositions and the creation of legal uncertainties, for a legal situation that is as clean as a tear."

The FBK has already made the standings official, determined the playoff pairings and set the match schedule.

Rahoveci 029 came out with an official reaction on Friday night. Rahoveci 029 finished seventh and remains in the Super League.

"We clearly emphasize that the decisions of the FBK are based on regulations and must be respected by everyone. The Federation has acted in full compliance with the rules in force, which have been known to all clubs since the beginning of the season. As for our club, we want to be very clear: we are completely clean. Every achievement of ours is the result of work, sacrifice and maximum commitment on the field, without any violation and without any favors. Attempts to create doubts or to reduce the value of what we have achieved are unfounded and do not change reality," wrote Rahoveci.
