ZKA: Graçanica overbilled taxpayers in violation of the regulation

The National Audit Office has identified a series of violations during the audit of the municipality of Graçanica

The auditor has evidenced that in five cases the municipality charged taxpayers with higher taxes because they did not comply with the municipal regulation or the tax zones defined in this regulation.

"The value to the taxpayer that occurred on the invoice should be in the amount of 41,166 euros, and not as presented in the invoice (financial card) according to the Municipality in the amount of 54,596 euros. So we have over billing of 13,430 euros. These areas by regulation belong to the second area, but according to the data (in the financial card and protax) these cases are billed according to the fourth area. According to the responsible municipal officials, the "Magjistralja Prishtine-Ferizaj" road does not appear in the Protax property tax system in the three cadastral areas (even though it passes through the three villages of Çagllavica, Llapnasell and Preoc as defined areas in the regulation) and it is not foreseen either in the Property Tax Regulation" says the audit.

In two other payments that totaled the total value of 30,908 euros for "cleaning services" according to the contract with the public company, invoices for the paid expenses were missing from the payment file.

"Instead of the invoice, the contractor had submitted only the specifications for the services performed in terms of value and quantity. Whereas, in the case for hotel services in the amount of €1,410, in addition to the invoice and payment requests, the follow-up report regarding the purpose, the agenda and the officials who used the hotel services was missing. Also, in six payments we found that the financial obligations in the total value of €216,906 were paid after the legal deadline of 30 days with delays of 30-115 days, while in 10 cases the pledge of funds to SIMFK was made after receipt of the invoice or acceptance of goods or services" says the ZKA report.

The auditor also found violations regarding subsidies.

"In the subsidy of the project "Development and Promotion of Tourism in the Municipality of Graçanica" in the amount of 40,000 euros, we have identified that the beneficiary of the subsidy did not bring evidence from the court that the project manager and the responsible person of the NGO are not under investigation for crimes criminal. The Municipality had not appointed a supervisor to monitor the implementation of the project and the beneficiary had not provided proof that there is no unpaid financial obligation to the Municipality" says the report

In the subsidy of the project "Celebration of the Day of the Municipality of Graçanica" in the amount of 6,000 euros, the ZKA also identified that the application documents/forms were not signed by the authorized representative of the beneficiary NGO and by the project manager/leader, as well as were not completed as required by the NGO financing regulation, even though the same project was approved by the Evaluation Committee.

"The beneficiary of the subsidy did not bring evidence from the court that the project manager and the responsible person of the organization are not under investigation for criminal offenses," the report states.

In the project for "Development of Agriculture and Growth of Agricultural Activity" worth 11,000 euros, the auditor had identified that the application lacked a statement on double financing and a statement on projects financed by public sources.

"The beneficiary of the subsidy did not bring evidence from the court that the project manager and the responsible person of the organization are not under investigation for criminal offenses. No evidence has been provided that the beneficiary does not have any financial obligations to the Municipality. The (alternative) Certifying Officer who had certified the payment for this subsidy was also a member of the Subsidy Request Assessment Committee".

For the project "Rehabilitation of rivers, protective walls, bridges and local roads of the Municipality of Graçanica", the estimated and budgeted value for three years (2019,2020,2021, 1,378,928, 2019) according to the budget tables (PIP) was 2,996,324 euros, while the contract was connected in 1,617,396 with a value of XNUMX euros or XNUMX euros higher than the estimated value.

"Also, with the 2020 Budget Law, sufficient funds were not allocated for the realization of this project. Payments for this project for 2020 were 465,378 euros. The project "Reconstruction, rehabilitation and improvement of the water supply and sewerage network in the territory of the Municipality of Graçanica", the estimated and budgeted value for three years (2020,2021,2022, 300,000, 2020) according to the budget tables (PIP) was 697,214 euros, while the contract was concluded in 397,214 with a value of 2021 euros or XNUMX euros higher than the estimated value. Even with the XNUMX budget law, the allocated funds were not sufficient to realize this project," says the auditor's report.
