Two companies participating in the tender for the supply of dialysis beds and equipment for the Nephrology Clinic at UCCK have filed complaints with the Procurement Review Body, alleging legal violations and favoritism of the winning operator. Another company has announced that it will also file a complaint.
Two companies participating in the tender for the supply of dialysis beds and equipment for the Nephrology Clinic at UCCK have submitted complaints to the Procurement Review Body.
The complaints were filed following the decision of the University Clinical Center of Kosovo to announce the company "Medi Health" as the winner of the tender worth 843,750 euros.

Letter to the Reader — Why We're Asking for Your Support ContributeIn its complaint, the company "Ko Med" claims that it was unfairly eliminated with incorrect technical justifications and that their request for reconsideration was not treated with evidence.
"We were eliminated as allegedly irresponsible by the Contracting Authority with a banal justification that the technical requirements for dialysis machines were allegedly not met and that it was not proven that these machines are installed in at least three European Union countries. The failure to provide clarifying information shows that the Contracting Authority intended to eliminate and discriminate against our bid and favor the operator recommended for awarding the contract," states the complaint of "Ko Med".
Meanwhile, the company "Medicom" considers the tender manipulated.
"Our offer was 30% cheaper (€260.000 less) than the competitor. We suspect that we were dealing with a 'manipulated' tender and deformation of the technical specifications to suit only a certain manufacturer, which also does not meet the conditions of the tender dossier. This has led to the unjustified elimination of Fresenius Medical Care - Germany equipment, which is a global leader in this field and over 50% of the world market and over 60% of the European market is owned by this manufacturer. The Contracting Authority did not request additional clarifications on the documentation, but eliminated the offer directly, which is a legal violation according to Article 72 of the Public Procurement Law," the complaint of the "Medicom" company states.
And the company "Argo Med" stated that even though they had met all the criteria, they were eliminated from the competition, for which they announced that they will complain to the PRB on Monday.
KOHA had reported a week ago about this tender, for which suspicions had been raised that the winning company had been favored.
The Basic Prosecution Office in Pristina has confirmed to KOMA that the case is being investigated.
"The Basic Prosecution Office in Pristina is handling this case and the investigations are still ongoing. The case is open and investigative actions are being taken to collect evidence to determine whether there were violations during the public procurement procedure. Given that the investigations are active, at this stage we cannot provide any other specific details, so as not to prejudice the investigative process," the Prosecution's response states.
The winning company "Medi Health" did not respond to the questions sent by KOHA, and they were not accessible on the contact number listed at the Kosovo Business Registration Agency.
KOHA has also sent questions to the UCCK since August 28 regarding the claims of economic operators, but so far has not received any response.
