Tender for supply of Nephrology with hemodialysis equipment, under review

The tender for the supply of the Nephrology Clinic with hemodialysis equipment and beds has been returned for review. The PRB made this decision due to the technical expert's failure to fully review the complaint of one of the participating companies. The tender for the supply of hemodialysis equipment and beds at the Nephrology Clinic has been returned for review by the Procurement Review Body, following complaints from economic operators.

At the review panel session on Tuesday, the PRB made this decision due to the technical expert's failure to fully review the complaint of the company "Argo Med".

The tender of 843 thousand 750 euros, won by "MediHealth", was concluded in the PRB after complaints from three companies. In the initial assessment, the technical expert had concluded that the offer of the company "KoMed" is in accordance with the requirements of the tender dossier and that its elimination by the UCCK was unfounded. 

According to the technical expert's assessment, the UCCK's claims for elimination are unfounded.

"The technical expert explains that the reason for the elimination of the CA does not stand, because the complaining EO has provided evidence from the manufacturers, which proves that the equipment is installed in European Union countries, such as Germany, Spain, Portugal, Greece. Furthermore, the technical expert explains that the complaining EO has also submitted, as additional evidence, a statement from the manufacturer 'Dialife' from Switzerland, which confirms that the 'Dialife' equipment meets the criteria for Systole. Based on the above-mentioned explanations, the technical expert proposes to the review panel that the complaint of the complaining EO be approved as well-founded, that the contract award notice be canceled and that the case be returned for re-evaluation," the expertise states.

The complaint of “Argo Medit” was also canceled by the UCCK, with the justification that the company does not have evidence that it has equipment installed in at least three EU countries. But the PRB found that the technical expert did not examine the case in detail and requested that the complaint be reconsidered.

Medicom's appeal was rejected on the grounds that the equipment did not meet the criteria of the tender dossier. However, the company's lawyer, Kushtrim Palushi, described this decision as biased.

"They said that the main reason for the elimination of 'Medicom' was allegedly that the model it applied for was an old model and, according to them, it doesn't matter whether it meets the criteria or not, it's enough that it's old and they eliminate it. This approach is very tendentious and prejudiced, because if we didn't meet the criteria, we should have been eliminated for that reason, not for the fact that the device is not the latest model," said Palushi. 

KOHA previously reported on the tender that continues to be the subject of investigation by the Basic Prosecution Office of Pristina, which confirmed on Tuesday that the Police have been authorized to collect information to fully clarify the case.

"Regarding your question, we inform you that the State Prosecutor has issued authorization to the Kosovo Police to collect and compile relevant information for the full clarification of the case in question," the announcement of the Basic Prosecution Office in Pristina states.

"MediHealth", which was announced as the winner of the tender, is one of the operators that has won the most contracts from the UCCK and SHSKUK during the year, but it is also on the list of companies most fined for failure to deliver on time. 

In Tuesday's review, she did not participate, as they said that only the dissatisfied parties participated, while adding that their offer is in accordance with the law and the tender dossier.
