The Supreme Court in Skopje has annulled the decision of the Penale regarding the extradition case of former KLA soldier Blerim Ramadani, who about a week ago escaped from the house arrest that was assigned to him in North Macedonia, after last month was arrested, based on an arrest warrant issued by Serbia. 

According to the supreme decision, the case has been returned to the Criminal Court.

"The Criminal Council under the organized crime and corruption sector within the Criminal Court-Skopje, while making the decision, with which it concluded that the legal prerequisites for extradition have not been met, did not give a justification on what reasons it was based on accepted that the decision initiated in accordance with Article 75 paragraph 1 of the Law on International Cooperation in Criminal Matters, as an abbreviated procedure, should be conducted as a regular procedure in accordance with Article 68 in relation to Article 51 of the same law", it is stated in the reasoning of Supremes, reports Alsat.mk.

According to the announcement, the action and taking of such a decision in the Court of first instance, according to the assessment of the Supreme Court, is unclear and incomprehensible, without relevant reasons from which the council was based when taking the decision. 

"During the serial action, the court of first instance is obliged to take into account the highlighted remarks, as well as the provisions of the Law on International Cooperation in Criminal Matters and the European Convention on Extradition with the First and Second Additional Protocols regarding The law on the ratification of the third additional protocol of the European Convention on Extradition, and on the basis of them, with the proper implementation of the provisions, a fair and legal decision was taken", it is emphasized in the reasoning of the Supreme Court's decision. 

In the case of Ramadan, a Macedonian court decided on August 1st that he be kept under house arrest at an address in Skopje, where he would have to stay until August 16th.

The authorities of Serbia, according to the Ministry of Foreign Affairs and Diaspora of Kosovo (MPJD), have accused Ramadani of having committed war crimes in the region of Nerodima in the summer of 1999. According to the Ministry of Foreign Affairs, Ramadani was a member of the Operative Zone of Nerodimes of the KLA. Daçiqi requested his extradition to Serbia during a visit to the Tabanovci border crossing on July 25.
