The Supreme Court Panel has dismissed as inadmissible the appeal of prosecutor Merita Gaka-Kurtishi, filed against the decision of the Kosovo Prosecutorial Council (KPK) to elect Elza Bajrami-Kastrati as a member of the KPK.

Prosecutor Gaka-Kurtishi had requested the annulment of the KPK decision of November 13, 2025, claiming that the electoral process was unlawful. She had also requested the annulment of the KZ-KPK notification of November 1, 2025, as well as the obligation of the KPK to re-announce and organize a new electoral process.

However, after reviewing the documentation and evaluating the legal basis of the appeal, the Supreme Court found that the appeal is not admissible.

In its decision, the Court emphasized that the case does not concern the appointment or dismissal of a prosecutor, nor the dismissal of a member of the Prosecutorial Council – the only categories for which prosecutors have the right to appeal directly to the Supreme Court.
