The special rejects the release of Nasim Haradinaj

Nasim Haradinaj

The Special Court has refused to release the former secretary of OVL-KLA, Nasim Haradinaj.

According to a Special announcement, the president of the Specialized Chambers of Kosovo (DHSK), judge Ekaterina Trendafilova, decided on October 12 to review the modification of the decision of Nasim Haradinaj, for his release with certain conditions, after receiving a report from the administrator Fidelma Donlon regarding Haradinaj's behavior during his detention in the DHSK detention facility.

The announcement states that Trtendafilova estimated that although "Haradinaj has taken some steps towards rehabilitation, there is still room for improvement".

"The president took into account that although the criminal offenses for which Mr. Haradinaj was sentenced are undoubtedly severe, taking into account the rather negative effect of the disclosure of confidential information on (potential) witnesses, there were several factors that could weigh in favor of modifying his sentence. The president also pointed out the expressions of regret from Mr. Haradinaj during the oral session and his pledge not to commit other actions that can be characterized as criminal offenses against the administration of justice. However, the president emphasized that Mr. Haradinaj has disciplinary precedents in the Detention Unit (NJP). Consequently, the President judged that although Mr. Haradinaj has taken some steps towards rehabilitation, there is still room for improvement", the announcement states.

For this reason, it is said that the president has ordered the administrator to submit a report regarding Haradinaj's behavior in the future within a certain period in the context of the decision on the modification of his sentence.

Haradinaj was sentenced by the Special Court to four and a half years in prison on May 18, 2022.

The former leader of the OVL-UÇK, Hysni Gucati, was also sentenced to 4 and a half years in prison, for whom Special announced on Tuesday that he was released with some conditions.

Gucati and Haradinaj were declared guilty of obstructing official persons in the performance of official duties, intimidation during the criminal procedure and violation of the secrecy of the procedure. They were found not guilty of the crime of revenge.
