The Assembly is constituted on Monday, the Government has not been decided

With the election of the Speaker and Deputy Speakers of the Assembly, the constitution of new institutions will begin on Monday, after the February 14 elections. After the constitution of the eighth legislature, the governing cabinet headed by Albin Kurtin is expected to be voted on, but Vetëvendosje has not indicated whether this will happen on the same day. For the vote of the President of the Assembly and of the Government, the winning coalition secured enough votes, but not for the vote of the president, which requires the participation of 80 deputies in the vote.

The constitution of the eighth legislature, where the president and vice-presidents of the Assembly are expected to be elected, will take place on Monday at 10:00.

According to the announcement of the administration of the Assembly, the first point will be the formation of the temporary commission for the verification of the quorum and the mandates, to be followed by the oath of the deputies. The constitutive session will be concluded with the election of the Speaker and Deputy Speakers of the Assembly.

Although quick actions have been promised in the constitution of the Assembly to pave the way for the voting of the governing cabinet, such a thing is not certain. This is due to disagreements between non-Serb communities, some of which have not yet been determined whether they will be part of the Government or the opposition.

As a result, they do not have an agreement on the name they should propose for the deputy speaker of the Assembly, which belongs to them based on the Constitution.

Fikrim Damka from the Turkish Democratic Party said that, before the session, they will have a meeting with the representatives of other communities, as he did not rule out the possibility that the vice president will be elected by rotation.

"Tomorrow morning we have a meeting with the communities, we will decide. Maybe we will have the vice president from the non-majority communities on a rotating basis. However, everything will be decided tomorrow and we don't expect any disagreements", said Damka.

As for voting for the Government, Damka said that they have not decided yet.

The Legislature is not considered constituted without electing the vice-presidents.

Meanwhile, a voting process takes place in packages for the vice-presidents proposed by the parties of the majority community, while the second vote is held for the other two vice-presidents - the Serbian one and the vice-president proposed by the other non-Serb communities.

And, voting for the Speaker of the Assembly is done separately.

The right to propose the candidate belongs to the winning party and it is expected to be Glauk Konjufca from Vetëvendosje.

It is not known whether the Government will also be voted on Monday and who will exercise the office of president, after the election of the new speaker.

But officials of Vetëvendosje have hinted that the current parliament speaker, Osmani, will continue to exercise the duties of the head of state and that the election of the Government will take place before the election of the president.

The former president of the Constitutional Court, Enver Hasani, calls the path that is intended to be followed wrong.

"It is very clear that tomorrow (Monday last year), after the formation of the Assembly, it will go down the wrong path of establishing the executive and then another body that is not a power and is called the President of the Republic. This is done for political and political reasons and it may seem okay. In the constitutional aspect, however, this is not the case: the ranking of the constitutional bodies necessarily imposes the need to follow their hierarchy defined by the Constitution. I am talking about their formation, which happens after the new general elections", said Hasani.

According to him, it is a big mistake when it is said that "anything that is not expressly forbidden by the Constitution is allowed", "because the constitutional norms are not criminal norms, in their overwhelming part".

"Very rarely do constitutional norms stop. They mainly authorize. Such logic can be followed in criminal law, but never in constitutional law. This is because such logic inevitably leads to anarchy and chaos. This time it may seem nice and sweet to someone, but the next time they will regret such a thing. The arrangement of bodies in a constitution is an implicit constitutional norm", emphasized the professor of international law. He added that nowhere in the Constitution of Kosovo is national treason on the part of the head of state foreseen, but it is implied.

"Nowhere in the Constitution of Kosovo is the prohibition of the President of the Republic to be the head of a political party, but a President of Kosovo has paid a price for this because such a prohibition comes from the very nature of the Kosovar constitutional system; nowhere in the Constitution of Kosovo does it say that the President is prohibited from signing agreements for the exchange of territories, but such a thing is implied, because it is an implicit constitutional norm..." Hasani emphasized.

He does not see any obstacle to the formation of the legislative body, because the speaker of the Assembly belongs, according to the express constitutional norm, to the winner of the elections, this case to the LVV.

Before the constitutive session, the contender for prime minister Albin Kurti and the candidate for president Vjosa Osmani met the representatives of all subjects.

Until now, Kurti has secured the majority for voting for the Speaker of the Assembly and the Government. Besides the 58 deputies of Vetëvendosje, he also has the support of 5 deputies from the ranks of the communities.

But the votes are not certain even for the president, who can be elected with 61 votes, but with the condition that 80 deputies participate in the vote.

PDK and AAK have ruled out the possibility of making a quorum.

PDK has also mentioned the possibility of producing another candidate for president.

"We will contribute only if we have a president who would represent the unity of the citizens and the political spectrum. Whenever the topic of the president is on the agenda, we will talk as the leading opposition party with other opposition parties to look at the possibility of a consensual person. For this reason, we are open to talk with those who have won the elections. If we can reach a person who can represent the unity of the people and the political spectrum, we will support him", said Betim Gjoshi from the PDK.

Commenting on the possibility of new elections, he added that the PDK is not asking for them.

"It is the responsibility of the winner. The winner of the elections won the votes of the citizens to build the institutions. They must be to show a behavior towards other parties which would convince them to vote for an acceptable candidate. If the country goes to elections, the responsibility is clear. So far, we have not seen any interest from Albin Kurti to make Vjosa Osmani president. Otherwise, there would be a different order of topics", Gjoshi emphasized.

Meanwhile, the Democratic League has not given a final position.

The chairman of the LDK, Lumir Abdixhiku, has said that they will decide this after a meeting that they will hold only with Osmani when the issue of the president comes up.

KOHA has reported that the LDK's decision-making about whether or not the president will participate in the vote will depend on the future of Vjosa Osmani's party and on the deputies who have won seats within Vetëvendosje.

Sources within these developments have said that the chairman of the LDK, Abdixhiku, wants to make sure that Osmani will not extend the party structures where the electorate of the LDK would be affected. The head of the LDK also in recent statements has requested that the presidential candidate clarify her position against the LDK, as well as the deputies who belong to Osmani's group to clarify whether they will be part of the Government or the opposition.

The election of the head of state should be done no later than April 5, one month before the term of office of the acting president, Osmani, expires.

Failure to elect a new president leads to new elections.
