Political analysts, Agim Sopi and Melazim Koci, have said that with the verdicts on the issue of the constitutive session of the Kosovo Assembly, the Constitutional Court has created a "mess".
On Friday, the Assembly was constituted six months after the opening of the constitutive session. Deputies elected Nenad Rašić as the Deputy Speaker of the Assembly from the ranks of the Serb community. After the names of the Serbian List failed to be elected, not receiving the support of the majority, this party stated that it will complain again to the Constitutional Court about the manner of Rašić's election.
And according to Sopi, the Constitutional Court, with its unclear decisions, "is not putting an end to anything exactly."
"When it is not done as in the case of the election of the Government, which foresees what should be done and how, this is how the consequences come," he said on KTV's "Konfront" on Friday.
He also complained about the lack of consequences that should be imposed on those who violate the Constitution.
Meanwhile, Koci said that if the Serbian List complains to the Constitutional Court, there is a risk that there will be another suspension measure. He expressed his fear that the Constitutional Court will have a hard time determining that there was no violation today.
"I think it would be very difficult to decide here because if we rely only on the Constitution, the assembly is constituted, but not if the latest ruling of the Constitutional Court is taken into account," he said, adding that this dilemma comes from the point that emphasizes that the proposal belongs to the majority of the Serb community.
"I'm afraid they might say the election is unconstitutional, or they might have to disavow themselves," he added.
According to Koci, the Constitutional Court has been invoked in previous judgments in other cases, but not in the latest judgments.
Days ago, the Constitutional Court ruled that the Assembly can vote separately for deputy chairmen from among the communities, following the complaint of the Serbian List from previous sessions. It was reiterated that deputies can vote up to three times for a proposal for chair or deputy chair. And on Friday, the deputies of the Serbian List did not receive support.
By the time it was time for Nenad Rašić, MP from the Party for Freedom, Justice and Survival, to vote, the Serbian List had failed to secure enough votes for its nine MPs. Three voting processes were organized for each of the MPs: Slavko Simić, Zlatan Elek, Liljana Stefanović, Miljana Nikolić, Branislav Nikolić, Stefan Kovačević, Srdjan Popović and Igor Simić. However, none of them received more than 9 MPs' votes, out of 105 MPs who participated in the vote. MPs from the Vetëvendosje Movement and most MPs from the multi-ethnic group voted against them. MPs from the PDK, LDK and AAK abstained. And some MPs from non-Serb communities sometimes abstained and sometimes did not participate in the vote.
After the failure of the Serbian List deputies, parliamentary speaker Dimal Basha called for this party to nominate deputy Nenad Rashic as vice president.
He did not receive a response from the Serbian List. He repeated the request once more, and MP Igor Simić went to the podium to consult. He appealed to the Serbian List for the third time.
But Simić of the Serbian List said that they have put the candidates they support on the ballot and that if other actions are taken, they would violate the regulations of the Kosovo Assembly.
The Speaker of the Assembly, Dimal Basha, demanded that the Serb List declare that they reject the proposal of Nenad Rashiq for Deputy Speaker of the Assembly.
In the interpretation of the Serbian List MP, Rašić's proposal would be contrary to the Constitution.
"We will not participate in violating the Constitution and you will not force us to do so," Simić declared.
After that, the Speaker of the Assembly stated that the Serb List refuses to nominate the only Serb MP who did not submit to the vote. He said that, based on the regulation, in such circumstances the lottery procedure is put into operation as an unblocking mechanism.
"This is in harmony with the Constitutional Court's judgment," he reasoned. Basha.
But then he said that there was no need to hold a draw, since it was only about one MP. Basha put the election of Nenad Rashiq as deputy speaker of the Assembly to a vote. With the votes of the deputies of Vetëvendosje, the Democratic League and non-Serb minorities, Rashiq was elected deputy speaker. Nine deputies of the Serbian List voted against and those of the PDK and AAK abstained. 71 deputies voted for Rashiq, 9 deputies were against, while 24 abstained.
With his election, Speaker Basha declared the Assembly constituted.
