On February 9, parliamentary elections were held to determine the governing executive.
Regarding the mandate to form the Government of Kosovo, the Constitutional Court had determined that the first proposal of the name for prime minister is made by the party that wins the elections, namely the one with the most MPs.
"The party or coalition that has won the majority in the Assembly, as defined in Article 95, paragraph 1, of the Constitution, means the party or coalition that has the majority of seats in the Assembly, whether an absolute or relative majority. The President of the Republic, based on Article 95, paragraph 1, of the Constitution, proposes to the Assembly the candidate for Prime Minister nominated by the political party or coalition that has the largest number of seats in the Assembly," the Constitutional Court's judgment states.
Furthermore, the Constitutional Court has emphasized that if the candidate for prime minister does not receive the necessary votes to be resolved, the president has the discretion to appoint another candidate, after consultations with political parties.
