Selimi: The Civil Code ensures equal treatment of spouses in personal property matters

The Minister of Justice, Selim Selimi, has spoken about the importance of the Civil Code. Speaking about specific points related to the matrimonial property issue, he said that this Code ensures an equal treatment of spouses in all personal and property matters and there is no discrimination.

"With the Civil Code, it is no longer allowed for the court to evaluate the contribution of the spouses in different ways, as it was in the current family law. In case of divorce/divorce, the court will divide the common property in equal parts 50/50 for both spouses, if they do not have a contract before marriage or during marriage", said Selimi.

Minister Selimi also clarified that the Civil Code provides for a contract before marriage and during marriage with which spouses can regulate property relations.

"The contract is not binding, but an opportunity offered to spouses", he added.

Selimi, at the invitation of the Chamber of Commerce of Kosovo, today participated in a virtual forum where the topic was "Civil Code and doing business". Dr. also participated in this forum. Kerstin Niethammer-Juergens, head of the EU-funded Civil Code Project, Alfons Lentze, Rule of Law Policy Adviser from the EU Office in Kosovo and Haxhi Gashi, lead expert of the Civil Code Project.

Speaking about the importance of the Civil Code, Minister Selimi said that this Code came as a result of the work and commitment of the Government, namely the Ministry of Justice, relevant actors of all institutions, representatives of businesses, civil society and local and international representatives.

The Civil Code was drafted by the Ministry of Justice, with the support of the European Union through a special project which was developed in two phases.

The Civil Code of the Republic of Kosovo will be structured in 5 books, which will include: 1. The general part, 2. Obligations, 3. Property and other real rights, 4. Family and 5. Inheritance.
