Closing statements are continuing at the Kosovo Specialist Chambers (KSCC) in The Hague in the case against Hashim Thaçi, Bashkim Smakaj, Isni Kilaj, Fadil Fazliu and Hajredin Kuçi.
The parties are answering the judge's questions. Prosecutor Matt Halling said that this case concerns the participation of a group of people who, through joint actions, attempt to obstruct an official in the performance of official duties.
According to him, the defense is departing from the law in terms of presenting its arguments.
"The defense is running away from the law, it's getting away from the law. The defense is getting away from the evidence as much as possible," he said.
He said that attempting to commit obstruction of justice would inevitably lead to its commission.
"It is inevitable that the commission of criminal offenses against the administration of justice had the potential to lead to the obstruction of official persons in representing witnesses in this criminal case," Halling said.
"What the defense teams are doing in terms of the law is very clear. They do not take into account the jurisprudence of case 7 at all, considering it unreasonable or unclear even when this jurisprudence is related to the legal aspects of this case. They refer to the Kosovo criminal code, the requirements of this code and the limitations that the legislator did not write at all," he said.
He said that the defense is taking certain circumstances of past cases and presenting them as if they fall within the bounds of certain legal provisions.
"The defense does not accept what the reason is that they cannot find a case in Kosovo that deals with similar facts to the case we are discussing today. The reason for this is that there has never been such a case," he said.
