The expert on political issues, Vigan Qorrolli, has said that if the Assembly is not constituted by April 6 and the procedures for the elections of the new president begin, then the February 14 elections have no constitutional value, since according to him, within in May or June, new parliamentary elections must be held.
He said that Kosovo is facing some strict constitutional deadlines, which the new legislature of the Assembly must implement in an imperative manner.
"The elections set for February 14, 2021, will select the 120 members of the VIIIth Legislature of the Assembly of Kosovo, who then, according to the Constitution, must vote for the new Speaker and the Presidency of the Assembly - an act which officially calls it to constitute the new legislature. The new assembly can be constituted at any time and due to the short deadlines, it should be convened around the middle of March, but not later than the end of this month", he said.
According to him, the Government can also be voted in the first sessions of the new Assembly.
Qorrolli has said that the election of the new President of the Republic is expected to be the keynote of the political stability of the Assembly, since according to him, this is related to strict constitutional deadlines.
"On May 6, 2021, the temporary term of office of the UD President, Vjosa Osmani, expires, a position she holds as a derivative of the position of Speaker of the Assembly. In the event that the new Assembly that emerged from the February 14 elections elects a new president, then the term of office of the President will NOT be extended - in any case, with a new president or not, who according to the constitutional prerogative of also exercises the office of president — but this office lasted at most until May 6. This deadline will not be extended (even) if we have a new Speaker of the Assembly", he said.
According to Qorrolli, the procedures for the election of the new President according to Article 86 (2) of the Constitution "must begin no later than 30 days before the end of the mandate of the current President".
He further adds that the procedure can start anytime after the constitution of the new Assembly, but not later than April 6, 2021.
If the first week of April is entered without the procedures for electing the President, then article 82.1 (3) of the Constitution is activated, which dissolves the Assembly, and which says: 'if within the period of 60 days from the day of the start of the election procedure, the President of the Republic is not elected'. In other words, the Assembly is dissolved if the President is not elected in this way, while the second variant also dissolves it in case the President fails in three rounds of voting — article 86 (6) — "The Assembly is dissolved and elections are held within 45 days ", Qorrolli wrote.
