The Democratic Party of Kosovo considers the presidential decree to dissolve the Assembly, and consequently the new elections, to be constitutional. This party believes that the parliamentary majority, specifically the Vetevendosje Movement, is pushing the country towards a new institutional crisis.
The Chairman of the Parliamentary Group of the Democratic Party of Kosovo, Arian Tahiri, has said that Kosovo is heading towards elections again not because of a lack of alternative solutions, but because of their rejection by the parliamentary majority.
He added that the problem is not the president, but the desire to control every institution by VV.
"If you know you don't have the votes, then in politics you seek agreement and consensus. But when you reject the agreement and insist only on party candidates, the message is clear: the problem is not the election of the President, but the desire to control every institution of the state. The desire to subject all other political actors to an authoritarian mentality, to capture every institution," Tahiri said at a press conference.
While defending PDK's position in the presidential election process, Tahiri added that until now, the Assembly has never failed to elect a president.

He added that PDK supported the idea of a consensual candidate from the Jashari family, was open to a comprehensive political agreement, and ultimately offered a limited agreement only for the election of the President.
"So, there were alternatives. There were solutions. All that was missing was the political will of the parliamentary majority. Or, to put it more precisely: in the Vetëvendosje Movement, the thirst and desire for power and absolute control prevailed," Tahiri said.
Meanwhile, PDK MP, Përparim Gruda, said that the dissolution of the Assembly is a direct constitutional consequence.
"The Assembly of Kosovo has exhausted its right to elect the President within the constitutional deadline. Consequently, its dissolution and the President's decree are fully in accordance with the Constitution of the Republic of Kosovo," Gruda said.
He emphasized that in European constitutional doctrine there is the principle of prohibiting profiting from institutional inaction.
"The competence to elect the President is not discretionary, but a positive constitutional obligation. Failure to initiate the procedure constitutes a constitutional institutional inaction that blocks the creation of a state body," Gruda declared.
According to him, the interpretation that the Assembly can avoid dissolution by not initiating the procedure for electing the President at all is contrary to constitutional logic and the principle of effectiveness of the Constitution.
"If it is accepted that the distribution only occurs after the third vote, then the Assembly may never convene the session and extend the mandate beyond the constitutional provisions. This contradicts the principle of effectiveness of the Constitution," he said.

Gruda added that the correct interpretation of the Constitution requires that constitutional deadlines not be neutralized through institutional inaction. He concluded that the Assembly has violated the Constitution by inaction and that the consequence of this situation is its dissolution and the holding of new elections.
"The President has acted entirely in accordance with the Constitution by exercising her powers to dissolve the Assembly, and it is expected that the election date will be set soon," Gruda concluded.
