The decision of the Complaints Commission, which gives the right to the company "KosovaMed HealthCare" to provide services, has proven how the bodies and departments within the Ministry of Health interpret the same situation differently.
The Complaints Commission, when it gave the right to this company, underlined that "it has a license for the sale and purchase of medical equipment and the provision of medical professionals in licensed health institutions".
The Legal Office of the Ministry of Health issued a legal opinion regarding this decision of the Complaints Commission. It has found that the Complaints Commission has come to the wrong conclusion regarding this company.
"The Legal Department has asked the KKPPM to secure the respective license of the company 'KosovaMed HealthCare', where according to the evidence this operator is licensed under the title 'Activity license - wholesale distributor of medicinal products and equipment'. Therefore, the finding in the aforementioned justification of the decision of the Complaints Commission is not based on the right and does not coincide with the license of the respective activity issued by the competent body in this case by the KKPPM", says the opinion of the Legal Office of the Ministry of Health .
KOHA has sent questions to the Ministry of Health about why it was referred to in the opinion that it has a license for products as well, when this company only has one for equipment. From this institution they said that they will eliminate this error, which they called technical.

The Legal Office has also "advised" the Complaints Commission to once again analyze the documents at its disposal.
The Complaints Commission refused to clarify where they based their decision. And in AKPM they said that they do not issue such licenses at all, as the Complaints Commission has claimed.
The Chairman of the Complaints Commission, Shaban Osmanaj, on Friday (March 15) promised KOĖHA an answer to this issue. However, on Tuesday, this committee considered itself incompetent to speak on this issue.
"The Complaints Commission does not have the authority to give an opinion or comment on the decision issued by the commission itself," says the response of the Complaints Commission.
KOHA has never asked for comments or opinions from this committee. The main question he put to him was on which law were they based when they said that this company "has a license to provide staff", since such a license does not exist.
And regarding this matter, on March 15, KOHA sent questions to the company "KosovaMed HealthCare". Neither of them have offered an answer.
In an earlier answer, on one side they said that they have a license and on the other that they don't need it for the contracts they have with the municipalities.
The Health Inspectorate in two municipalities, during the months of October and November of last year, issued a decision to suspend the work of this company on the grounds that it does not have a license for the provision of services for which it was engaged. This company has won tenders in several municipalities for the provision of home health care, as well as in the spaces of Family Medicine Centers.
