Ministry calls Bajrami's accusations about announcing high positions tendentious

government

The Ministry of Justice has called the statements of former LDK MP Hykmete Bajrami, that the announcement of high-level leadership positions by the ministry is contrary to the law, untrue and tendentious. 

The ministry said in a response that Bajrami's claims are neither factually nor legally valid, and that they "constitute an attempt to create a false perception in public opinion about regular and lawful processes."

"The procedures for these positions were initiated through the official request of the Ministry of Justice for their opening, within the framework of the Recruitment Plan for 2026, forwarded on April 27, 2026 to the Ministry of Digitalization and Public Administration, at the time when the Government was exercising its full mandate and before the entry into force of the restrictions for the resigning Government. In accordance with Law No. 08/L-197 on Public Officials, the organization and further development of recruitment procedures for senior management positions is carried out by the ministry responsible for public administration, according to a clear framework defined by law," the reaction states.

The Ministry further added that it has acted in full compliance with the legal framework and institutional planning. 

"The publication of the vacancies on the state electronic recruitment portal (https://konkursi.rks-gov.net) on April 28 and the right to apply until May 28 are procedural developments that stem directly from this regular and lawful request and do not constitute in any case a new initiation in the period of restrictions." 

Regarding the three advertised positions – for directors at the Agency for Free Legal Aid, the Agency for the Administration of Sequestered Property, and the Inspectorate of the Ministry of Justice – Bajrami said that these three institutions have become part of the "wave of illegal competitions."

"The Law on Government is clear. Article 31 - Limitations of the Government in Resignation stipulates that the Government in resignation: 'Shall not initiate new procedures for appointment to public positions, for the appointment of which it is competent based on the relevant laws,'" she wrote. 

Hykmeti added that the incumbent government does not have full legitimacy to announce the positions.

"It should only carry out necessary tasks, not open competitions for key positions in the administration, agencies, justice and public institutions. Institutions are not party property, justice is not a haven for militants and the state is not an employment office for the outgoing government."
