Even though it was opposed by the opposition MPs, the Committee for Legislation, Mandates, Immunities, the Assembly's regulations and the supervision of the Anti-Corruption Agency, in the meeting held on Friday, the Draft Law on the amendment and completion of the Law on the Prosecutorial Council of Kosovo was approved.
The chairman of the Commission, the deputy of the government, Adnan Rrustemi, has said that this draft law was worked on with maximum objectivity and with open discussion with everyone related to this matter.
"We have adopted the model of the selection of judges in the Constitutional Court in a special commission made up of the Assembly composed of representatives of independent institutions that will have the responsibility of selecting the selection of the recommendation of the session of non-prosecutor members. We have treated it with maximum objectivity and open discussion with everyone related to this matter. There may be differences in the nuances of the regulation model, but the effort was sincere to bring a report with amendments", said Rrustemi.
The Deputy of the Democratic League of Kosovo (LDK), Driton Selmanaj, was against voting on this Draft Law. According to him, he has a lot of room to violate the recommendations of the Venice Commission.
"We come to a situation where there is a drastic change, especially in the composition. The government has proposed 19 members of the Prosecutorial Council. You have reduced them to 7, which makes a drastic change to the Government. On the other hand, I am not saying that you have done a great job, maybe you have worked, you have spent energy, you have worked, but I see that I have my own dilemmas because the recommendations of the Venice commission have been addressed. I think there is a lot of room to undermine the recommendations of the Venice commission. And I can't vote for that. I will vote against", said Selmanaj.
Rrustemi responded to this.
"Based on the number of prosecutors that Kosovo has, the number of 19 members is very high, therefore, through the working group as an Assembly as a Commission in relation to the Venice Commission, we have returned to the number 7", said Rrustemi.
Even AAK MP Besnik Tahiri was against the voting of this Draft Law.
"My first observation as the Assembly and in this case as the Government, we have wasted a long time when the opinion of the Venice Commission was given in relation to the violations, the defects that this Law has foreseen, issues that need to be fixed. We have wasted a lot of time since the increase in the number of 8 attorneys who are not part of the prosecution has been seen very openly. It has been a serious trend of an independent constitutional politicization. Let's not ask for 8 more prosecutors who are not members of the prosecutor's office, but the total number of 19 is falling to 7, so it's a big question mark why it's happening. With these problems, I can't vote for him. Even the evaluation is delayed", said Tahiri.
Even PDK deputy, Hajdar Beqa, has emphasized that he does not support this Draft Law and as PDK they will see if there are elements to send it back to the Constitutional Court.
"The Venice Commission has seen something, recommendations, comments, some were able, you said that they were able with good intentions, but it was not seen that they wanted to control the Procurial Council in some form. Increase the number once, then decrease the number. You have 3 prosecutors and 3 non-prosecutors, it does not honor the Council that we are talking about prosecutors of all levels. It is not well coordinated. As PDK at this stage we do not support this Law. We will see if there are elements to send back to the Constitutional Court. We will analyze it within the framework of the political subject, we will not support it either in the Commission or in the plenary session", said Beqa. / EO
