The MoD changes the article that talks about marriage, does not indicate when it will be approved by the Government

The Ministry of Justice has changed the article on marriage in the Draft Civil Code, including the point that regulates the civil union.

This point, the cause of which is the approval of the Draft Code being opposed even by members of the ruling party, allows the registration of civil unions between persons of the same sex.

Officials of the Ministry of Justice did not disclose details. And, other changes have been made in the Draft Civil Code. 

The Ministry did not even indicate when the document will be processed for voting in the Government.

"The draft of the Civil Code is almost finalized, with the appropriate changes in Article 1138 and other changes. The draft code will be processed for voting in the Government, to be finalized later as an initiative after the voting procedures in the Assembly", says a response from the Ministry.

Prime Minister Albin Kurti announced a quick vote on this draft code last week. During his stay in Germany, he promised that he will personally commit to secure the necessary votes for his passage to the Assembly.

The prime minister's promise has raised hopes among LGBTQ+ community rights advocates.

But Arbër Nuhiu, director of the Center for the Development of Social Groups, says that if the Draft Civil Code is approved in the old version, it will be sent to the Constitutional Court.

"If that draft goes, it's not a question of whether something is right. Normal, if it remains like this we will take us to the Constitutional Court. But I do not believe that the prime minister, considering his statements, has sent the Civil Code in the old version, but I am very convinced and call on the Government that this matter should be regulated within the Code, otherwise it is a violation of the rights of the citizens of Kosovo", said Nuhiu.

The draft Civil Code failed to be approved two years ago. Along with the non-majority communities, 14 MPs of the Vetëvendosje Movement voted against him, while 3 others abstained.
