Hoxha: So far, the principle of the Constitution has been violated in all cases, except for the Jahjaga case
Erblin Hoxha, an expert on political issues, said that in all cases, except that of Atifete Jahjaga, the election of presidents violated the constitutional principle that the president should be a unifier for all.
In the "Special" on KTV on Thursday, Hoxha said that in recent speeches, the leader of Vetëvendosje, Albin Kurti, has hinted that he has given up on having one of his party members lead the Presidency. According to him, Kurti has also requested this from the Democratic League, with which he is negotiating for the formation of institutions.
"We have always violated the Constitution, except for Mrs. Jahjaga who has not been involved in politics. In principle, we have violated the Constitution with everyone else... We have had presidents who have not broken the law, but have violated the principles of the Constitution. The principle of the Constitution says that the president should be a unifier of all. Which of the party presidents we have had has been a unifier of all? None. The principle has been broken here. They have agreed among themselves because we have had two parties that have said that 'there is no problem for us, these are small and they cannot do anything to us'. The principle says that the president should not lean either to the left, nor to the center, nor to the right, but should be the personification of general unity," he said.
Salihu: It seems that Kurti is serious about the post of president remaining under the VV umbrella
Bekim Salihu from the GAP Institute said that the acting Prime Minister of Kosovo, Albin Kurti, wants to keep the post of president under the umbrella of the Vetëvendosje Movement. Salihu said that the reason why the Assembly was not constituted today is that Kurti wants to enable his partners to propose a name for the Speaker of the Assembly.
"Mr. Kurti has the votes for both the government and the Assembly. The fact that Mr. Kurti did not propose the Speaker of the Assembly today was not a political game but rather his political willingness to reflect or enable his partners to propose a name for Speaker of the Assembly that is not from Vetëvendosje. It seems that Mr. Kurti really does not want the president to move to other political levels. He wants to remain under the umbrella of VV," Salihu said in a Special on KTV.
Salihu said that in recent years, Kosovo has transformed into a state where all political decisions are oriented solely on Constitutional Court rulings.
"We have become a state where all decisions or political decision-making is oriented or based only on judgments and not on democratic decision-making that results from electoral processes or necessary leadership compromises... Even today, messages were sent that this legislature, from its very beginning, will again face important or dangerous decisions of the Constitutional Court, dangerous in terms of functioning, of course," Salihu said in a special on KTV.
Salihu also stated that the LDK is seeking the post of president, as it is a position that cannot be dismissed by the prime minister.
Ramaj: What happened today in the Parliament was pressure on LDK from VV
Journalist Saranda Ramaj has seen as pressure on the Democratic League of Kosovo, the request of the leader of Vetëvendosje, Albin Kurti, to postpone the issue of the constitution of the Assembly, so that there is more time for him to negotiate on the issue of the formation of institutions.
LVV and LDK have considered the discussions between them positive so far. However, Kurti stated that without resolving the presidential issue, the others should not be continued.
"I saw it as Kurti's pressure on the LDK not to move from his and VV's position that the position of president should not be given to the LDK, but on the other hand, what has been said publicly by actors from both parties, that they have been offered the position of speaker of parliament," Ramaj said in the KTV Special on Thursday.
Ramaj assessed that it would not be problematic if someone from VV were elected Speaker of the Assembly today and after reaching an agreement there was a change, as has happened in the past.
She said that Kurti sees the LDK as a more fragile partner due to its political power but also due to divisions within the party.
Ramaj has said that Kurti may also be open to new elections, considering the poor results of other parliamentary parties in the last elections.
Today, the constitutive sessions began in the Assembly. However, Kosovo has not yet had a functional Assembly. The eleventh legislature was not constituted in the session that began on Thursday, as it was interrupted at the request of the leader of the Vetëvendosje Movement, Albin Kurti, who requested additional time for discussions with party representatives, with the aim of reaching an agreement on the issue of the president.
The two opposition parties, PDK and AAK, have rejected discussions with Kurti, while he has held three meetings with LDK that have been considered positive.
Koci: If the Assembly is not constituted by tomorrow, then the Constitution will be violated
Political scientist Melazim Koci has said that if the Kosovo Assembly is not constituted by tomorrow, then the Constitution will be violated.
Koci said in a special on KTV that the Constitutional Court's ruling from last year is very clear and states that the Assembly must be constituted 30 days after the certification of the results by the Central Election Commission.
Koci says he was surprised that the Vetevendosje Movement did not constitute the Assembly today, considering that it has the numbers. Vetevendosje alone with minorities can form a majority in Parliament.
"If the Parliament is not constituted by tomorrow at 24:00, then according to the 2025 verdict, there is no dilemma left. It is a constitutional violation, as the verdict was very clear, firm and concise. The Parliament must be considered within 30 days. That deadline ends tomorrow at 24:00," said Koci.
He said that if the Assembly is not constituted then he expects the matter to end up in the Constitutional Court and either a clarifying provision will be made there or the country will automatically be sent to elections. Koci said that the 2025 Constitutional Court ruling does not mention any measures in the event that the Assembly is not constituted.
