Five important contracts were part of the table that dealt with harmful contracts implemented by Kosovo institutions, including the consequences they have.
The contract for the highway for Skopje, the contract with passports, the Dardafon contract, AXOS, as well as the privatization process of Brezovica, are counted in this case.
Alban Hashani, executive director of the Riinvest institute, presented a study drawn up by this institute, where he mentioned the lack of transparency and professionalism.
He has asked for an increase in the role of the prosecution in this aspect, as well as that of the Assembly.
"170 million would potentially be the damage if all the plaintiff parties would win in the dispute with the government of Kosovo. The good news is, or is it bad, that we are already losing 65 million, so if we put them in perspective, these are somewhere around 5 percent of Kosovo's budget, potentially if the case of Dardafon is decided again not in favor of In Kosovo, this can increase to 90 million", said Hashani, KsP reports.
He further mentioned the main shortcomings of the contracts.
"Firstly, there is a lack of professionalism, so it is clear that there is a lack of professionalism in the design of public contracts, secondly, there is a pronounced lack of transparency, and thirdly, there are suspicions and proofs of misuse of the official position", said Hashani.
He added that the responsibility for this belongs to the government, which as an executive has responsibility for this.
The Minister of Economic Development, Vladrin Lluka, said that the problem is the stance against the contract for which the commitment was made.
"The problem here, I believe, lies more in the attitude towards that contract that we have already committed to, it has always caused us problems, that we have not stood up to it, or at least we have agreed, we have signed a contract, maybe even you know that "we managed to fulfill the criteria that we agreed on in the contract, so I don't blame him, I'm talking specifically about the big contracts, they are drawn up in an extremely professional way, but that part of the tolerance that was done, will tell me the lack of professionalization who do not know what their own capacities are, they faced me with that contract, that is the key problem and it has caused us many problems", said Minister Lluka.
He said that the presentation in the arbitrations should be done by serious companies, because the presentation in the arbitrations is also a problem.
In the absence of the Minister of Infrastructure Pal Lekaj, Deputy Minister Fehmi Mujota took the floor, who said that each government must implement the contracts it receives from the previous government, because otherwise it can cause damage.
"I think there is a little defect, if it can be said to blame, in the serious approach at the moment when the change of governments takes place, I say it with competence and responsibility, I say it publicly if the mandate had ended or if I had another ministerial term, the contract with Bechtel Enka, Elez's Skopje-Han would have no dilemma and no defect. Why. One would ask why? Why, I would not have asked for the extension of the contract", said Mujota.
Deputy Korab Sejdiu said that the Government has responsibility to the public, while the private company has no responsibility for public money. According to Sejdi, the confidentiality clause should not have a place in public contracts.
"For me, it is very senseless when you, a minister, or a government in general, makes a decision without taking the opinion of a company which is being paid 8 million euros somewhere for that very reason, even called in a decision when the official government, that I am guaranteeing you that we do not have internal competences, we do not have internal capacity to evaluate something like this in our administration, we understand all the problems we have with the public administration, I am telling you with full responsibility that we do not have internal capacity, for that issue we also take a serious company that not only provides a legal interpretation of what the specific article is saying, but they actually issue even if the claim of the private party that is implementing a contract , building a highway or any other project, makes a request, but since they make the request, it doesn't mean you have to pay them", said Sejdiu.
The Government of Kosovo is facing court disputes, which arise as a result of inadequate formulation and implementation of public contracts. These court disputes show that the Government of Kosovo and other public institutions have failed to design complete contracts and respect the obligations arising from such contractual relationships.
