The UCCK, four general hospitals and the Agency for Medicinal Products have been led for years by acting directors. Several competitions for directors have been canceled due to irregularities found in the selection of candidates.
The Kosovo Agency for Medicinal Products (KAPM) has been managed by an acting head for seven years, in violation of the law.
This institution has not even managed to finalize the last vacancy for executive director, as last week it canceled the one announced on February 28.
Four months after the final results were announced, the entire process has been overturned by the Independent Oversight Council for the Civil Service, after it found violations during the compilation of the shortlist of candidates.
"Because for the job position of the senior management category "Executive Director" in one case it included candidates who did not meet the criteria, while in the other case it did not include in the shortlist candidates who met the competition criteria, these actions are in violation of the provisions of the law on public officials;... Due to the violations identified above, this recruitment procedure is considered illegal," the decision of the Independent Oversight Council for the Civil Service of Kosovo states.
The KMA has not responded to these findings and has not indicated when the new competition will open.

The University Clinical Center has also had an acting director for one year and six months.
Two competitions for the position of director have been canceled so far. The last one was canceled on April 29, with the justification of exceeding the legal deadlines. The UCCK did not indicate when the new competition will be opened either.
"We are aware of the importance of institutional stability and the functioning of leadership positions in a regular and sustainable manner. For this reason, the competition for the position of director of UCCK is planned to be opened within a reasonable period, in coordination with the responsible authorities and in accordance with the legal procedures provided for," the UCCK response states.
With the amendments to the Law on Public Officials, which entered into force on June 2, the possibility of holding a position with an acting position has been extended from one to two years.
The Legal and Political Studies Group assessed that holding director positions with acting directors negatively affects institutional integrity and that after exceeding the legal deadline, even the decisions made are contestable.
"There is another legal consequence, which is the declaration of the decisions of these acting officials as illegal, after exceeding this deadline. So, institutions must act in a timely manner, accurately and open recruitment procedures and carry them out according to the law in force," said Ema Pula, project manager at GLPS.

In addition to UCCK, the position of director of the Vushtrri Hospital, Mitrovica Hospital, Ferizaj Hospital, and Prizren Hospital is also filled with acting directors.
SHSKUK has canceled for the second time the competition for the selection of directors at the Ferizaj and Mitrovica hospitals.
