Former President of the Constitutional Court, Enver Hasani, has stated that the acting Prime Minister, Albin Kurti, aims to create a "Third Republic".
According to him, the non-implementation of Constitutional Court judgments indicates the intention to change the constitutional order.
"Kurti will create the Third Republic. The Third Republic must have a Constitution. The moment you do not implement the judgments of the Constitutional Court, it means that you will overthrow that order. The Constitutional Court has been terrorized, the judges have been called names, it has been below every level. With these actions, you are not hiding it," Hasani said.
Speaking about the importance of the Declaration of Independence and the Constitution of Kosovo, Hasani said that the Declaration of Independence is a unilateral legal act in the international aspect.
"The Declaration of Independence in the international aspect is a unilateral legal act. Through this act, which is done orally or in writing, and when you say this, any state has the right to take you to court," he said.
Hasani emphasized that the rule of law is a fundamental principle of the European legal order and that, according to him, it is embodied in the Declaration of Independence and the Constitution of Kosovo.

"We live in Europe, where the rule of law is sacred. This means that the Declaration of Independence and our Constitution have embodied these. At the heart of the rule of law is non-discrimination and equality of all before the law. This is the 'ABC' of Western legal culture. If we want to unilaterally impose the will of the majority on minorities, I am convinced that there will be problems," he said.
He added that amending the Constitution cannot be done without the support of non-majority communities.
"It's not like they're saying, that without Serbs the Constitution is changed with two-thirds of the double, Albanians and non-Albanians. All non-Albanians and four or five Serbs," Hasani declared.
