Guerot: The Constitutional Court is a respectable institution outside Kosovo, respect it too

The French Ambassador to Kosovo, Olivier Guerot, has said that the Constitutional Court of Kosovo is a respectable institution abroad, and as such its decisions should be respected within the country.

The Constitutional Court has suspended the work of the Assembly until a decision is made on the request of the Serbian List regarding the issue of the deputy speaker from among the Serb community. The Assembly has not elected the Serbian deputy speaker, but the Speaker of Parliament Dimal Basha has declared the Assembly constituted.

Asked about the government's stance on this issue so far, Guerot said he did not want to comment since the issue is in the Constitutional Court.

"But I want to say that the Constitutional Court is a very respectable institution outside Kosovo. It has been accepted as a full member of the European Association of Constitutional Courts, as well as the Francophone Association. Because it is respected abroad, I think it should also be respected in Kosovo. Therefore, I will refrain from commenting on what others may say, but I would advise institutions to continue to respect the independence of the court. It is among the pillars of the Republic of Kosovo and has our full support," he said after the debate on "disinformation and fake news in election campaigns" organized by the Media Center in Çagllavica.

Referring to the political impasse and the complete lack of formation of institutions, Guerot said that "it is unfortunate that we are in this situation," stating that in addition to Kosovo, France is also in a similar situation regarding the Government.

"We also have a prime minister, but we do not have a full government," he said. "It is not a good situation for any country, not even for Kosovo. The French Development Agency has developed several projects for Kosovo."

He further said that they have started cooperation with Prime Minister Albin Kurti on these projects, but they are ready to continue them with any incoming government.

"But now we are stuck," he said, referring to the political impasse.

Asked about the dialogue with Serbia, the French ambassador said that dialogue remains the only path to progress.

"Dialogue is not dead," he said. "Advocates of 'dead dialogue' advocate for no progress. Dialogue facilitated by the European Union remains a relevant platform for dealing with issues."

The Constitutional Court has imposed a temporary measure on the constitutive session, prohibiting the deputies from taking any action and prohibiting the development of any procedure for the formation of the new Government of Kosovo. The measure was imposed ex officio and based on the request of the deputies of the Serbian List. At the end of August, the Assembly of Kosovo elected the speaker and four of the five vice-speakers, dividing the voting of the vice-speakers from the non-majority communities. None of the deputies of the Serbian community received sufficient votes for the deputy speaker of the Assembly, and the new speaker, Dimal Basha, declared the institution constituted. Following this decision, the largest political entity of Serbs in Kosovo, the Serbian List, appealed to the Constitutional Court, claiming that Basha's decision violated the Constitution by dividing the voting of the vice-speakers from the minority communities.
