The judge who released Sekiraq is expected to go without consequences

No measure will be applied to the chairman of the court, Agim Kuçi, on the decision to let Enver Sekiraq, who has since escaped, be released. Kuçi was suspended and in the Basic Court they showed that the decision was taken without asking the members of the judging panel. But now, the investigative panel has concluded that the decision was legal, while sources of TIME have said that it was based on the statements given by the members of the judging panel.

About three months after the escape of Enver Sekiraqa, judge Agim Kuçi, who had released him, is expected to escape without any measures.

After Sekiraqa was sentenced to 25 years in prison for pushing for the murder of the policeman Triumf Riza, the chairman of the court, Agim Kuçi, decided to replace the measure of house arrest with the one of freedom protection, from which he escaped.

The Judicial Council (KJC) has suspended Kuči from work, and the reasoning of the Basic Court in Pristina was that the judge made the decision contrary to the law, since he did not consult with his colleagues on the panel. 

But, after three months, the investigation panel found that the decision was taken by the three members of this body. Time sources have said that the decision was based on the statements given by the members of the judging panel, who were interviewed. In the Judicial Council, they did not speak about the change of statements or about the report.

"The Kosovo Judicial Council (KJC)... still has not accepted the report from the Investigative Panel and the Disciplinary Office, so as soon as the report is accepted within the set deadlines, the case will be processed, according to the law in force. Therefore, at this stage of the procedure, we cannot comment more", said the KJC.

Albina Shabani-Rama, president of the Basic Court in Prishtina, is the one who publicly stated months ago that Judge Kuçi decided to replace Sekiraqa's house arrest with an appearance at the police station, without the approval of the court.

Now, when in the investigative panel the members of the judging panel have said the opposite, the president of the Foundation has refused to give comments on this circumstance.

"The moment the president of the court initiates the disciplinary procedure at the KJC, her powers end and for all the questions that interest you, please contact the Judicial Council of Kosovo", they said at the Basic Court in Pristina.

This court has convicted Sekiraqa for the third time for "inciting the grave murder" of the policeman Triumf Riza. 

Unlike the two previous decisions, when he was sentenced to 37, respectively 30 years of imprisonment, this year Sekiraqa was sentenced to 25 years of imprisonment.
