The Basic Court in Ferizaj starts the suspension of works in multi-storey buildings without criteria

The Basic Court in Ferizaj, after the initiation of a lawsuit by the residents of the neighborhood "Gëzim Salihu" in this city, has assigned a temporary security measure to stop the works of a business that was building a multi-storey building in the middle of the neighborhood. Due to this and several other constructions without criteria, the residents of this neighborhood protested days ago by blocking the road, which was reported by KOHA.

According to the residents, this neighborhood has started to be degraded by several multi-storey buildings, while the municipality has not taken measures. The residents have also initiated a lawsuit against the municipality regarding this issue, therefore they are asking the competent bodies to stop the works in some other objects that do not meet the criteria.

In the ruling of the Basic Court of Ferizaj, which KOHA has provided, it is said that the plaintiffs' proposal is approved as well-founded, so that the Temporary Security Measure is set and the opponent of the security is prohibited from interrupting all works related to the construction of the object business collective 2B+P+11+PH.

"The claimants-proposals, through the proposal for the determination of the measure, have emphasized that the claimants are at risk from the works and damage may be caused to their houses, since they are on the border with the plot on which the construction permit was granted of the collective housing facility. Among other things, they emphasized that the construction permit granted by the Municipality of Ferizaj was given without obtaining the consent of the neighboring residents, and that according to the legal provisions, it is mandatory to obtain the consent of the neighbors for the granting of the construction permit, and they added that without the appointment of this as long as the opposing party will not take certain actions to avoid causing damage to the plaintiffs, the proponents", it is stated in the decision of the Basic Court of Ferizaj.

In an interview for KOĖN, the director of Urban Planning in the Municipality of Ferizaj, Arbër Bytyqi, said that the granting of permits for some residential buildings in this neighborhood was issued in the past, while the director must implement it.

"We encourage the residents that if they notice that there is something that the legal aspects have not been respected, to use their rights. But you said earlier that based on the planning documents, high-rise construction is planned there and this planning document must be respected", Bytyqi said.
