Eugen Cakolli nga Instituti Demokratik i Kosovës ka vlerësuar se koha e mbetur deri më 6 tetor – afati i fundit për zgjedhjen e presidentit – e bën përmbylljen e procedurës për ndryshimet e Ligjit për Gjykatën Speciale “shumë të vështirë” brenda afateve të përcaktuara me Rregulloren e Kuvendit.
Ai ka thënë se dorëzimi të premten mbrëma i projektligjit nga Qeveria në Kuvend “e ka ngushtuar ndjeshëm hapësirën kohore për shqyrtim dhe miratim, brenda afateve sipas Rregullores”, duke marrë parasysh kërkesën e PDK-së për miratim para 6 tetorit.
Cakolli ka shpjeguar procedurën që do ta marrë projektligji në Kuvend deri në miratim. Për një shqyrtim më të shpejtë, Kuvendi ka në dispozicion mekanizmat e përshpejtimit dhe të shkurtimit të afateve procedurale.
Ai ka sqaruar se meqë materialet e plota të projektligjit u shpërndahen deputetëve sot, më 3 tetor, me afatet dhe procedurat që parasheh Rregullorja, projektligjit do t’i duhet kohë të kalojë nëpër secilën shkallë deri në miratim nga Kuvendi.
Procedurat që parasheh Rregullorja e Kuvendit, shpjeguar nga Cakolli:
1. The Committee on Legislation, after being assigned by the Speaker of the Assembly as the responsible committee, may examine the draft law in principle as of today, applying the exception that the Rules of Procedure allow for the convening of meetings in special cases. The majority of the members of the committee must be present for the meeting, while the recommendation for a vote in principle is approved by the majority of the votes of the members participating in the vote. The Committee then sends the recommendation to the Assembly for approval or disapproval.
2. A regular plenary session or an extraordinary session may be called at the request of 40 members of the Parliament. For the regular route, the meeting of the Presidency, as a rule, is held no earlier than 48 hours from the announcement, while the agenda and materials for the plenary session must be distributed to members of the Parliament at least two working days in advance.
3. For consideration by accelerated procedure, a request from at least 30 deputies or the Government, addressed to the Speaker of the Assembly, is required. This procedure applies to draft laws related to national security, public health or budgetary and financial issues. While deviation from procedural deadlines can be proposed by at least six deputies and must be approved by 2/3 of the deputies present, not necessarily by 80 deputies.
4. Sidoqoftë, edhe procedurat e përshpejtuara kanë afate minimale dhe duhet të jenë në përputhje me Kushtetutën. Duhet të kalojnë së paku 48 orë nga shpërndarja e materialeve deri te shqyrtimi i parë dhe pastaj së paku 72 orë nga miratimi në parim deri te shqyrtimi i dytë. Pra, gjithsej së paku pesë ditë.
Moreover, it should be recalled that the Constitutional Court has repealed decisions precisely for evasion and approval of laws when the shortening of deadlines had prevented deputies and committees from conducting substantive review.
5. If the materials have already been distributed and the Legislation Committee approves the draft law, its first reading in the session can be held on Monday, October 5th at the earliest.
6. After approval in principle, the draft law is returned to the committee for consideration of provisions and eventual amendments, as well as for consideration by the standing committees. Respecting the minimum of 72 hours of this procedure, the second review and final approval can take place on October 8 at the earliest.
7. After approval, the law is sent to the President for promulgation no earlier than eight days from approval. The President then has up to eight days to promulgate or return it. If he does not act within this period, including in the event of a potential new election, the law is considered promulgated even without a decree and is published in the Official Gazette. Laws usually enter into force 15 days after publication.
8. Even if it is approved within a shorter period than the Regulation allows, the law enjoys the presumption of constitutionality, until the constitutional court establishes the opposite. For this, at least 10 deputies may challenge it within eight days of its approval, both in terms of content and the procedure followed. If it is challenged through this procedure, the promulgation of the law awaits the final decision of the court.
