The temporary board of "Trepça" annuls the decisions that the previous board took on the day it was dismissed

The temporary board of the company "Trepça" has announced that it has annulled all the decisions that the previous board, which was dismissed by the Government of Kosovo on Wednesday, made in a meeting held on Wednesday.

"On 28.09.2023, the first extraordinary meeting of the temporary supervisory board of Trepça Sh.A. was held. In this meeting, the illegal decisions of the former Supervisory Board were annulled, due to the fact that they did not have a quorum to hold the meeting since there were only 1/3 of the members and the second were dismissed from being a member of the Supervisory Board and all the decisions in the meeting of 27.09.2023 are illegal", it is stated in their announcement.

The announcement states that according to the Law on General Administrative Procedure, an administrative act is illegal if "the public body that issues it acted without competence".

"In this case, they did not have the competence and did not have a quorum to hold a meeting since the same people were dismissed by the Government of the Republic of Kosovo, so they held a meeting despite the fact that the same people were dismissed and all the decisions are illegal". the notice says.

On Wednesday, the Government of Kosovo, in the meeting that started at 10:00, decided to dismiss the Board of "Trepça" and appointed the temporary Board.

At the same time, three already dismissed members of the Board have made a decision to dismiss the acting head of the enterprise, Enis Abdurrahmani, and have appointed Enis Muzaq instead.

Meanwhile, the Minister of Economy, Artane Rizvanolli, said at the Government meeting that the dismissed Board was dysfunctional.

But according to Hysnei, they had a quorum to make decisions.

"We had 5 members, two of them earlier asked to be relieved of their duties, so we have three members left, the board was functional and two thirds were enough to make decisions", Hyseni emphasized.
